According to Antena 3, President Iohannis’ complaint regarding the modification of the competition law was rejected by the Constitutional Court by majority vote. The Court rejected, as unfounded, the unconstitutionality exception and considered that the provisions of the Law amending and complementing Competition Law No. 21/1996 are constitutional in relation to the criticisms made, reports CCR.
The law had been challenged in the Constitutional Court by President Iohannis, a law amended in Parliament, which currently stipulates that the number of council members increases from 7 to 11 and it is no longer the president who appoints them but Parliament. For this reason, President Iohannis appealed to the Constitutional Court.
Today, the judges of the Constitutional Court rejected the notification of the president, being the constitutional law at this time. According to the amendments to this law, the appointment of the members of the plenary session of the Competition Council rests with the plenary session of Parliament at the proposal of the parliamentary groups of the two chambers, while in the old law, the appointment corresponded to the President of Romania.
