Paid days off for parents: settlement procedure …

Today the procedure is applied to settle the allowances granted to parents who stay at home with their children, starting this fall, based on the Government Emergency Ordinance 147/2020. The procedure is, in essence, the same as that established for free parental data based on Law 19/2020. The companies will initially assume the costs, pay the corresponding taxes to the state and only then will they request the liquidation of the gross allocations to the state.

FREE DAYS. To date, parents of children under the age of 12 who cannot attend school or kindergarten because units have limited or suspended activity in the context of the coronavirus epidemic, you can ask to stay home with the little ones at the base OUG 147/2020 – paid days off.

As in Law 19/2020, parents who stay at home are entitled to a gross allowance for 75% of the base salary of a working day, but no more than 75% of average gross profit (i.e. maximum 4,072 lei).

Initially, the subsidy is borne by the employer of the employee’s parents., and then request the money from the state in the settlement system. The National Employment Agency published Order 593/2020 in the Official Gazette on Friday, which contains the liquidation procedure and which apply today. However, settlements are required from one month to another, so only in October will it be possible to request settlements for holidays paid in September.

Under the new order, employers will apply to employment agencies that must be dated and signed by the legal representative (this was in spring a reason to reject applications under Law 19/2020, the fact that the document was signed by someone other than the legal representative). Settlement request must be accompanied by (sample documents are here):

  • the list of employees who benefited from the days off, as well as the allowance granted during this period;
  • copies of payroll and time sheets that demonstrate the granting of the allowance for each day off;
  • the declaration under the responsibility of the legal representative of the employer certifying that the list provided above contains the people who meet the conditions regulated by GEO 147/2020;
  • proof of payment of taxes related to the paid vacation allowance (income tax, pension contributions, health and employment).

The settlement documentation will be sent in a maximum of 30 days. of paying taxes related to paid parental leave allowances, either online (via here.gov.ro), or in print. Then, the settlement is made, by transfer to the bank accounts of the employers, within 15 days after the presentation of the necessary documents by the employer.

Therefore, similar to the mechanism of Law 19/2020, companies will first pay the corresponding allowances and fees and only then will they demand the return of the money to the State.

Important! The main difference with the paid leave granted under Law 19/2020 is that allowances awarded based on GEO 147/2020 will be fully recovered by state employers. Law 19/2020 allows to recover only the net provision paid to the parent company, not the related taxes.
