The head of state signed on Wednesday, September 16 of this year, the decree promulgating the Law that modifies and complements some normative acts on electoral matters (PL-x 559 / 09.14.2020).

According to the normative act, Romanian voters domiciled / residing abroad will be able to exercise their right to vote in additional electoral lists and in another section of the constituency to which they belong, if they have recently changed their address.

“Voting in the country takes place on a single day, which can only be on Sunday. Abroad, voting is also carried out on Saturday, immediately before the voting date,” stipulates the law.

According to her, parliamentary political parties are political parties and organizations of citizens belonging to national minorities that, in the last elections to the Senate and the Chamber of Deputies, met, individually or in alliance, the electoral threshold and obtained mandates of deputy or senator or Those who did not participate in the last parliamentary elections, but on the starting date of the electoral calendar for the parliamentary elections, have as members 7 senators or 10 deputies.

The presidents of the electoral tables of the electoral colleges abroad and their alternates are appointed by the Permanent Electoral Authority, at the proposal of the heads of diplomatic missions and consular offices. The appointment is made based on the applications of citizens with the right to vote, signed and dated, declaring compliance with the conditions provided by law, sent by mail, fax or email or sent to diplomatic missions and consular offices.

Decisions regarding the appointment of the presidents of the offices of the electoral colleges abroad and their deputies are communicated to the Electoral Office of the constituency of Romanian citizens domiciled or residing abroad.

The appointment of the presidents of the polling stations abroad and their alternates will begin 30 days before the voting date, once the premises of the polling stations abroad are established, and will be completed no later than 15 days before of the voting date. it will be made public by publication on the website of the Constituent Electoral Office for Romanian citizens domiciled or resident abroad.

According to article 16, para. 1 of Law 208, the person who meets the following conditions may be admitted to the body of electoral experts, by decision of the AEP: having Romanian citizenship; knows Romanian, written and spoken; has the right to vote; has a state of health corresponding to the performance of the function; is not part of a political party; graduate of undergraduate studies in the field of legal sciences or in other fields; he is not prosecuted, prosecuted or convicted

According to the law, “in the situation in which the polling stations of the polling stations cannot be completed according to par. (3) and (7), are completed by the president of the electoral district office for Romanian citizens domiciled or resident abroad with personnel provided by the Ministry of Foreign Affairs, as well as by other public authorities, at the request of the MFA. The travel and lodging expenses of the personnel sent abroad to form part of the polling stations are borne by the Ministry of Foreign Relations ”.

All transportation, lodging, living expenses and other current expenses of the representatives of the political parties in the electoral offices of the electoral colleges abroad are borne by those who designate them, the normative act also stipulates.

The permanent electoral lists from abroad are drawn up by the Permanent Electoral Authority and sent to the electoral district office for Romanian citizens domiciled or resident abroad, no later than 10 days before the voting date, in accordance with the new regulations. .

Sanitary protection materials are provided by the Ministry of Health, and their transportation and distribution are carried out by the Ministry of the Interior and the institutions of the prefecture, with the support of the mayors. For polling stations abroad, health protection materials are provided by the Ministry of Foreign Affairs.

In the 2020 elections to the Senate and Chamber of Deputies, the mayors ensure, with the support of the prefects, under the conditions established by a government decision, the hygiene and disinfection of the polling stations.

“In the elections for the Senate and the Chamber of Deputies in 2020 that are held abroad, if the competent authorities of the country of residence withdraw during the voting process, for security reasons, in order to prevent and combat effects of the COVID-19 pandemic, the agreement on the conduct of voting operations in the polling stations organized at the headquarters of diplomatic missions, consular offices and / or outside of them, the voting operations in question cease to be carried out.
