Ahmad Chaik Mousa Hasan (35) has been sentenced to 19 years in prison for stabbing his wife 40 times with an ax and knives. The children witnessed the murder and tried to arrest the father.
Appears in the Borgarting Court of Appeal judgment. The murder took place at the family’s home on Christmas Eve 2018. He also injured his six-year-old son and was found guilty of serious abuse against children.
The 35-year-old has also been convicted of the negligent murder of his 19-week-old son the previous year, in February 2017. According to the verdict, the father left him alone in a tub of water for the boy to drown.
Background: Man charged with the murder of his wife in Sarpsborg
The Court of Appeal finds it clear that the murder of his wife was carried out in particularly aggravating circumstances. In the verdict, the court notes, among other things, that she was attacked and murdered in her own home, and subjected to massive violence, without the opportunity to defend herself.
“The defendant took knives in various places and went out and grabbed an ax from the toilet before the violence continued. The murder occurred in time, which supports the strong intention of the accused and the lack of respect for human life ”, the verdict affirms.
The verdict: showed the deceased in a video call
The Court of Appeals also notes in the ruling that the extent of the damage and the children’s description of the mother’s cry gives a clear picture of the significant pain and fear they must have felt.
According to the verdict, the children were present at all times, and they also tried to prevent the father from committing the murder. The court finds it aggravating that Chaik Mousa Hasan deprived the children of their mother and caregiver.
“The children were also with the father in the house about two hours before the police arrived, and the father forced them into the room where the mother was lying on the floor with a lot of blood,” says the verdict.
According to the verdict, the father also sent a message after the murder to a relative, in which he wrote that he had killed his wife. In addition, he showed his murdered wife on a video call.
– He’s not doing very well, he took it pretty badly, defender Tarik Abbou told VG on Monday afternoon, after talking to his client about the verdict.
They do not agree with the assessment of the Court of Appeal on the question of sanity. The court unanimously concluded that the accused was sane and criminally responsible.
– We believe that there are enough doubts, says the defender, who warns that they will appeal the verdict “as it is now.”
– incredible tragedy
– This is, first and foremost, an unimaginable tragedy, tells VG Tone Monclair, a lawyer for assistance for the development of the 35-year-old’s children.
She is of the opinion that the Court of Appeal has done extensive and painstaking work, and is satisfied that the court landed on the plaintiff’s claim.
– With regard to their reparation and compensation for the loss of breadwinner, they largely conform to what I consider correct.
He agreed that he was sane
The verdict was rendered on December 4. Chaik Mousa Hasan was ordered to pay half a million crowns in reparation to each of the children, in addition to compensation for the loss of breadwinner.
The parents of the deceased received NOK 200,000 each in restitution.
The central question was whether the 35-year-old was sane when he committed the murder. At this point, there was dissent in the Sarpsborg District Court when the case was heard there. Court-appointed experts also disagreed in district court on whether Chaik Mousa Hasan was psychotic at the time of the action.
The Court of Appeal unanimously concluded that he was sane and criminally responsible.
The experts were the same during the appeal hearing, but one couple changed their position so that all the experts on slightly different terms agreed that the defendant was not psychotic.
