How you paid determines if you can get the money back.

When the locker room man went bankrupt a few weeks ago, there were many who placed orders for what they had paid for. For many, the money they have ordered for goods and services from bankrupt companies will be lost:

“People have no idea how risky the down payment can be,” says Tonje Hovde Skjelbostad, a lawyer at the Legalis law firm and an expert in bankruptcy law.

DNB reports an increase in inquiries from customers of companies that have filed for bankruptcy.

– We hope this trend continues in the future, says Vidar Vidar Korsberg Dalsbø, DNB’s communications advisor.

The card provides legal protection.

If you have ordered goods or services from a bankrupt store, it is expensive, but you are still not sure if you will lose the money. But you have a job to do. First, you must send an email to the administrator stating your reasons.

– The starting point is that the claim must be reported to the state first. That is generally not far, says Skjelbostad.

When you confirm that the estate has nothing to offer, it is the payment method that determines what you are entitled to. Consumer experts have repeatedly recommended the use of credit cards for online purchases. Bankruptcy is one of the reasons why:

– If you have paid with a credit card, you have a law under the Financial Contracts Law; therefore, you must file a claim against the estate first and document it. But when you have paid with a card for an item you have not received, the credit will be held responsible, says Skjelbostad.

– No claims

Your rights to get back what you paid, for example, for a purchase of clothes or a plane ticket, depend on how you paid:

– Purchase made with the bax part of the card (the section without credit, edition note) and payment by invoice or bank transfer does not grant any claim right in the card regulations or to the bank in any other way. In these cases, the client must file the claim against the bankruptcy state, says Dalsbø on DNB.

A regular bank transfer has no delay until the customer has received the money, making the payment method less secure. A common form of money order payment is Klarna, which gives the customer a late payment term. This makes the payment a bit more secure as one may defer payment until the item is received.

However, Dalsbø recommends that you always use your credit card for online purchases, and especially airline tickets, where there is currently a lot of uncertainty and bankruptcy.

– Submit a written complaint

Buying with Visa or Mastercard gives you the right to claim through the payment network. Visa is as secure as Mastercard, but you need to make sure it’s the credit portion of the card used, says Dalsbø. It usually happens automatically, but if you can choose between debit / credit then choosing credit is important, he emphasizes.

– If the bank does not obtain a refund through Visa / MC, it will be the Law of the Financial Agreement and the terms of the agreement on the card that will be the leaders of the outcome of the case, reports Dalsbø.

What you do as a client is to present the case as a regular complaint:

– Submit a written complaint with the reasons: This can be passed to the Financial Complaints Board if you disagree with the creditor, says Skjelbostad.

Buying online with Vipps provides the same security as buying with physical cards, says Hanne Kjærnes, Vipps communications manager. It is assumed that there is a credit section on the card (Visa / Mastercard) that is linked to the Vipps application; You can also choose more cards to change in the Vipps app.

Receive many inquiries

Banks are receiving an increasing number of bankruptcy cases, but in principle it shouldn’t take that long to get the money back, says Dalsbø:

– Regarding treatment time, the case normally starts within three business days, and the advertised amount is generally refunded temporarily when treatment begins.

It may take some time for the case to be finalized, because the processing time on Visa / Mastercard varies and can take up to 60 days. According to Dalsbø, the cardholder is constantly kept informed and the status of the case can be monitored at the online bank.

DNB has devoted considerable resources to handling client cases and must initially have a good capacity to handle incoming complaints, says Dalsbø.

– But with extraordinary effort you can expect additional processing time. We believe that our clients understand this in this extraordinary situation in which we all find ourselves.

A little chance

If you didn’t pay by card and the company filed for bankruptcy, separatists may be a possibility, says Skjelbostad. This is the property of what you have purchased, such as a ready-made wardrobe.

– You should then display a message that the item has been shipped, or the like, showing that you own the item and can document the purchase, says the bankruptcy expert.

The right applies to a specific item in a bankruptcy state based on the item’s ownership. The starting point is that you only own the item when it is delivered, even if you have paid for all or part of it.

– But when making a purchase, you can claim that you become the owner of the product when you have paid in advance and, therefore, you will have the right to have it delivered. Here I want to emphasize “I can claim”, because from what I can see there is no clear practice in this regard, says Skjelbostad.
