“The presentation has been submitted for your record, I propose to the Head of the Legal Department of the Seimas Chancellery A. Kabišaitis,” the Seimas president told reporters on Thursday.

According to the President of the Seimas, according to the law, the candidacy of A. Kabišaitis can be presented in the Seimas after three months, and this time the nomination presentation time will not be coordinated with the Presidency and the Supreme Court of Lithuania (LAT ).

“The candidacy can be considered in the Seimas in three months and a service would be held. The procedure could resume in early September. We would no longer identify (submission) with the President and the Supreme Court,” said V. Pranckietis.

“If you are talking about the members of the Seimas that they could be, then, of course, only J. Bernatonis meets the requirements that would be established for a CC judge. Of the members of the Seimas, if we talk,” says the old man of the LVŽS faction of the Seimas.

V.Pranckietis said that A.Kabišaitis’ candidacy had not been coordinated with R.Karbauskis.

On Thursday, V. Pranckietis discussed the situation regarding the judges after the Seimas had previously rejected the three nominations for the CC in a meeting with President Gitanas Nausėda, but said he could not say when the head of state would nominate your candidate.

“We talked about when we would nominate candidates for the Constitutional Court, but I will not speak for the president, he asked me when I would like to nominate, I said this afternoon,” said the speaker.

In April, the Seimas rejected the three nominated candidates for the CC judges. The president of the Seimas V. Prackietis nominated the former chancellor of the CC Ingrid Danėlienė, the president Gitanas Nausėda, the lawyer Giedrė Lastauskienė, the then acting president of the SCL Sigita Rudėnaitė, the judge of this court Algis Norkūnas.

President S.Rudėnaitė had been nominated as permanent head of the SCL. Her candidacy was also rejected by the Seimas and at the same time removed from the post of President of the Civil Division of the SCL. This situation is now being clarified by the CC, which accepted Seimas’s appeal to assess whether the Presidential Decree and the Seimas Resolution had been properly formulated after the removal of a judge from office without a legal basis.

The President has confirmed that he intends to re-present the two candidates rejected by the Seimas to the courts, since he has not heard the reproaches expressed during the hearing in the Seimas.

The Constitution establishes that the Constitutional Court is renewed every three years by one third. The court is made up of nine judges appointed for nine years and for one term only.

The term of the judges will end on the third Thursday of March of that year. State officials who nominate CC judges must submit new judge nominations to Seimas no later than three months before the end of the judges’ tenure.

If a new Judge is not appointed within the prescribed time, the outgoing Judge will hold office until a new Judge is appointed and an oath is taken.
