Under the Military Service Law, a soldier is prematurely released from service when a court sentence comes into force that convicts him of a crime and is sentenced to a sentence preventing him from continuing his service.
The army didn’t like it
Arnas R., who was biting the bread of emigrants, returned to Lithuania last summer.
As he was unemployed and suspected that he might be called up in his homeland, he decided to apply for military service himself.
He began his service on September 28 and was awarded a temporary junior military rank.
“After starting my service, I became familiar with the army procedure during the first week. I didn’t like that life, the routine, I lacked freedom, I couldn’t do what I wanted,” Arnas R. later told the police.

The guy said he made a big mistake choosing the army voluntarily.
“After the first two weeks of service, when all the soldiers were in quarantine, I finally decided not to serve in the army,” he explained.
Get out of there with conviction
The young man came up with the idea that the army would move away from 9 months if he refused to take the oath to his homeland. He informed his commanders about this. They explained that he simply did not have that opportunity.
Arnas R. was warned that he would face criminal responsibility for noncompliance with the commander’s orders.
The guy was persuaded by the psychologist, the lawyer, and the battalion commanders.
“Everyone told me I had to continue the service, but I decided not to take the oath anyway. I expected to be expelled from the army for a conviction, ”said Arnas R.
On October 16, when all the soldiers came out to rehearse the swearing-in ceremony, Arnas R. took office.
A criminal case was initiated against him in accordance with article 317 of the Penal Code. for non-execution of the order. In court, the guy was sentenced to 20 days in prison and the sentence went into effect this week.

Such a case is exceptional in Lithuania. Last year, this was the only case presented under article 317 of the CC.
While the investigation was being carried out, he was to remain in the army and remain in pretrial detention, supervising the leadership of the military unit.
