Judge Samuel Alito ordered Pennsylvania to keep the most recent ballots received thus far, confirming a similar decision by State Elections Director Kathy Boockvar. The latter told CNN television that this part of the ballots is unlikely to change the overall result of the vote count in any case.
The desperate call for urgent intervention following the consolidation of Democrat Joe Biden and the upcoming victory over President Donald Trump involves thousands of votes.
Most of those votes are believed to have been cast by Biden’s supporters, but Republicans argue that these ballots must be rejected under Pennsylvania election laws.
The Republican Party initially wanted the Supreme Court to force ballots received after 8 p.m. local time, keep them separate from others, and not allow them to be counted.
There was concern that if these ballots were mixed with others, it would no longer be possible to reject them.
“Given the results of the general election on November 3, 2020, the vote in Pennsylvania could really determine who will be the next president of the United States,” Republicans emphasized.
“It is not clear whether the 67 electoral councils are separating the ballots received late,” the statement said.
Republicans have been fighting for more than a month to reverse Pennsylvania’s decision to accept ballots by mail if they are marked as mailed on or before November 3, but are adopted no later than Friday. The previous deadline for the adoption of ballots was the end of Election Day.
The Supreme Court of the States has ruled that this decision is lawful. Then the Republicans appealed to the federal judiciary.
On October 19, the United States Supreme Court, with one seat still vacant, allowed the state court’s decision to remain in effect, with four votes for and against.
However, the Supreme Court has indicated that it can still address the issue after the elections. It now has all nine members, including Trump-appointed conservative judge Amy Coney Barrett (Eimi Koni Baret), whose candidacy was confirmed in late October.
Trump openly said he wanted AC Barrett to participate in any Supreme Court ruling on the election.
Friday’s petition looks more like an effort to delay the announcement of voting results in Pennsylvania, as current trends show that the vote count is increasingly moving in favor of Biden.
If the proceedings are delayed, the Supreme Court may have enough time to begin hearing late ballots.
Even if the court orders the suspension of the vote count, this may not change the situation. Election analysts say the proportion of late votes may be significantly lower than the dominance of Biden’s votes against Trump in the state.
