On Tuesday, the scheduled nomination of candidates for CC judges was removed from the Seimas plenary session agenda and postponed indefinitely. This enraged A. Širinskienė.
“I can only note with great surprise that due to really incomprehensible circumstances, the appointments of the CC judges have been eliminated,” said A. Širinskienė before approving the agenda for the session.
A member of the peasant faction stated that one of the arguments of the head of parliament Viktorija Čmilytė-Nielsen, why it would be worthwhile to extend the session, was the appointment of the CC judges. According to her, now “in the middle of the night” these issues have been removed from the agenda.
“I think all those secondary issues on the agenda are certainly not so important that the Seimas pick them,” said A. Širinskienė.
According to her, the thoughts expressed at the meeting of the Seimas elders that the judges will not be able to swear live next Tuesday are fairy tales. A. Širinskienė proposed to return the appointment procedure for CC judges to Tuesday’s agenda.
“I suggest to stop doing anything when we meet to solve really essential things,” said A. Širinskienė.
Seimas President V. Čmilytė-Nielsen stated that due to the fact that some Seimas members were unable to participate in the session due to self-isolation or coronavirus and assess the changing situation, it was decided to postpone the topic.
Conservative Andrius Vyšniauskas claimed that the CC judges have not been appointed for almost a year, and the Seimas of the new term has been working for only a month and a half.
‘A. Širinskienė could answer this question, why did the old ruling majority not make this decision and accept new judges in time? First of all, answer this solution for yourself and only then ask this question, ”said A. Vyšniauskas.
Viktoras Pranckietis, a member of the Liberal Movement faction and former president of the Seimas, stated that it was A. Širinskienė who removed the issue of appointing CC judges from the agenda during the last term.
In response, A. Širinskienė claimed that the former speaker of parliament had plenty of time to present his candidacy to the CC judges and never did. V. Pranckietis replied that “a new year, but an old lie” and said that he had submitted the nominations on time.
“I’m looking at the rulers now, probably you no longer pay to count or you no longer pay to read,” crossed the peasant.
According to A. Širinskienė, the CC judges can be appointed during three sessions of the Seimas, therefore, as of November, according to the politician, this procedure was completed.
“When political manipulations occur, they are taken off the agenda almost overnight, which really raises a lot of questions. <...> Either you disagree with something or try to manipulate it for some reason. And if you’re planning to change the nominations, and I wouldn’t really be surprised if they change, then in that case, you’re saying it very openly.
Someone’s illness is certainly not a reason not to apply. <...> All the more because he lied from this rostrum that this session is being expanded precisely because of the CC judges, ”said A. Širinskienė.
According to her, in the extended session there are no questions on which the Seimas should choose. Vytautas Gabšys, a citizen, also supported this, saying that it would be fair to both the opposition and the rulers. He raised the question that if the CC is not nominated on Tuesday, it might be worth the Seimas to close the fall session on Tuesday.
Rita Tamašunienė, a member of the mixed group of Seimas members, emphasized that there were no important issues on the agenda this week. According to her, the laws related to its management must be resolved during the pandemic and the Seimas does not intend to adopt such laws this week.
Finally, the Seimas members did not support A. Širinskienė’s proposal to put the presentations of the CC judges back on the agenda. R. Žemaitaitis, representing a mixed group of members of the Seimas, stated that the current rulers had behaved in their “brutal decision” in the same way that the peasants had behaved in the previous legislature and “cleaned their feet. to the Constitution “.
“I really have a suspicion that other people will not be selected as CC judges. <...> Who can guarantee that the President of the CC Žalimas is not obliged to the Conservative Party to modify a certain resolution of the CC on the change of status of the first President of the Seimas. I would really like to receive such responses, “said R. Žemaitaitis.
All three nominees were rejected last April. Then, as the main reproach to them, it was mentioned that they are not specialists in constitutional law. In December, two of the same candidates and a new one re-entered the Seimas.
President Gitanas Nausėda and Acting President of the Supreme Court of Lithuania (SCL) Sigita Rudėnaitė present the nominations of lawyer Giedrė Lastauskienė and SCL judge Algis Norkūnas al Seimas for reconsideration.
The Head of State stated that he had not heard arguments about why his candidate was not suitable to work in the CC, so he did not look for a new one.
At that time, the president of the Seimas V. Čmilytė-Nielsen appointed Andrius Kabišaitis, head of the Legal Department of the Chancellery of the Seimas, to the CC.
At the beginning of the year, the former president of the Seimas Viktoras Pranckietis appointed Ingrida Danielienė, former chancellor of the CC. After the failed vote of the CC judges, V. Pranckietis registered the resolution on another candidacy, A. Kabišaitis, but it was not presented to the parliamentarians.
The Constitution provides that the Constitutional Court is renewed every three years for one third. The court consists of nine judges appointed for nine years and for one term only.
The mandate of the president of the Constitutional Court Dainius Žalimas and of the judges Gediminas Mesonis and Vytas Milius ended on March 19 of last year. They will remain in office until new judges are appointed. The judges of the CC are appointed and dismissed by the Seimas.
