In June, the CC stated that the norm of the Provisional Law of State Pensions for Researchers, when the time of service of a doctor or authorized doctor does not include the activity of researcher carried out after the age of 65, is discriminatory by reason of age. The court then recognized that the provision of the law that the state pension is not awarded and the granted is not paid until the investigators have secured income or even receive sickness, maternity and paternity benefits is also in conflict with the Constitution.
On Wednesday, the outgoing government decided to submit to the Seimas the amendments prepared by the Ministry of Social Security and Labor (SADM), which propose to eliminate these provisions, as well as abandon the principle that the seniority of doctor and authorized doctor does not include activities when receiving a state pension.
However, at the proposal of the Ministry, it has been established that researchers receive and pay a state pension only when they stop working in Lithuanian state research and study institutions or while implementing research programs financed from the state budget.
According to the Ministry of Social Affairs, the amendments to the law would be relevant to several hundred scientists today: some 400 people would resume paying state pensions to scientists by paying arrears from the day it came into force. the decision of the CC, that is to say, as of June 3, 2020. In addition, the arrears would be recalculated and paid to those who have acquired at least one year of research experience after this period.
The amendments would also affect about 50 more people who receive first and second degree pensions under the State Pensions Law, since the Ministry also proposes in this law to eliminate restrictions on insured income, as well as sickness benefits , maternity and others.
It is estimated that the implementation of the changes will require around 780 thousand. euros.
