The Government approved this Wednesday modifications to the Code of Administrative Offenses presented by the Ministry of Justice, which provide, among other clarifications, that failure to attend military service without just cause for up to 2 days would result in a fine of 420 to 900 euros . There is currently a fine of € 140-300.

At that time, a fine of between € 90 and € 180 (now € 30-60) could be imposed for breaching established military service obligations, and between € 180 and € 420 (now € 60-140) for repeated offenses.

It is proposed to strengthen this responsibility because, in the opinion of the Ministry of National Defense, the current levels of fines provided for in the Code “do not act as a deterrent to improve the standard of living in the country.”

According to the real data, the average amount of the fine imposed in 2017-2019 is only about 24 euros, ”the explanatory note states.

Other amendments are presented to the Seimas. For example, it is proposed to create legal preconditions for officials of the Department of Prisons to initiate an investigation of administrative violations when violations of the Tobacco Control Act are found in correctional institutions.

The objective is also to establish administrative responsibility for accessing or attempting to enter a protected facility with facilities and energy assets important to national security. A fine of € 30-70 could be imposed for this (again € 50 to € 250).

Under the amendments, breaches of the rules for the protection of energy facilities and equipment could be subject to a warning or a fine of 70 to 150 euros (now 14-30 euros) and a fine of 300 to 600 euros (now 60 to 140 euros) to the managers of legal entities. The maximum fine for recidivism could reach 600 euros for individuals and 2,400 euros for directors of legal entities.

It is proposed to reduce the maximum fine to 1450 euros for the presentation of incorrect financial statements of a legal entity by allowing a minimum order to be prepared and imposing an administrative order.

It is also intended to establish that the person who has reported a possible offense will also be informed of the decision to put an end to the administrative offense, if, in the opinion of the notifier, they have been harmed. You could also appeal the decision.
