The driver found himself in a strange situation: Police say he did not miss a pedestrian, but there was a bicyclist in the crossing

The Panevėžys resident said that according to the police officers who imposed a fine, a woman dressed to ride a bicycle at the crossing should be considered a pedestrian.

“According to them, the cyclist who set foot on the sidewalk is already a pedestrian. But I do not agree with that and I do not see pedestrians here, ”the man emphasized, adding that the Road Traffic Rules (KET) do not define that a cyclist is considered a pedestrian as soon as he steps on the sidewalk.

According to the Delfi reader, the fine imposed is small, but he is willing to try to defend his truth in court.

Pedestrian: only when riding a bicycle

According to the specialists of the Lithuanian Highway Police Service (LKPT), Article 2 paragraph 49 of the Road Safety Law states that a pedestrian is a person on the road who is not in a vehicle, as well as a wheelchair , roller skater, skateboarder, scooter driver., moped, motorcycle, sled, stroller or other wheelchair.

Meanwhile, the same law states that a person who drives a vehicle is considered a driver. Drivers are people involved in traffic in accordance with the additional requirements established by said law (drivers, riders, people who drive animals or birds on the road), as well as people who teach how to drive.

Officials also noted that cyclists cannot cross the road when walking in crosswalks.

In addition, it should be noted that when approaching the point where the road must be crossed, the cyclist must in any case reduce his speed and can only continue driving if he is sure that it is safe to circulate and will not disturb others. road users, ”says Delfi. In the response sent by the LCPT.

When asked when a driver sitting in a car should stop when he sees a bicyclist approaching a crosswalk, LKPT officials emphasized that both road users must comply with KET requirements and that a bicyclist is prohibited cross the street at a crosswalk.

Failure to pass a pedestrian when required by the KET is subject to a € 60-90 fine and may result in disqualification from driving for 1-6 months. Last year a total of 3,832 fines were imposed for this conduct, amounting to € 30,049.

The situation is debatable

Driving instructor and road safety expert Olga Židovlenkova told Delfi that the perpetuated situation was ambiguous. In particular, according to her, it is difficult to determine whether the cyclist was already in the crosswalk and the driver did not pass it, or when the woman reached the crossing, the car was already right next to it and its driver. it did not stop without causing an emergency.

The instructor is also skeptical of the officers’ statement that if a cyclist sets his foot on the sidewalk, he should be considered a pedestrian.

“By that logic, I can drive a car on the sidewalk and stand up to walk. I drive a car with an automatic transmission, there would be no need to press the clutch and there would be no damage; after all, I almost walked. On the other hand, it should be noted that KET does not strictly describe how a cyclist has to push a bicycle ”, said the expert, adding that the cyclist in the photo had not completely got off the bike, as KET requires – riding a bike .

Ms Židovlenkova also mentioned that according to the current KET, drivers must slow down when passing pedestrian crossings and be ready to stop if necessary. However, according to the driving instructor, such a controversial situation only proves that a video recorder is usually useful in the car, which would allow a more comprehensive evaluation of the event.
