“The panel of judges … decided to terminate the administrative case in accordance with the petitioner’s statement to the accused municipality of Kaunas,” Judge Daina Kukalienal announced.

According to her, the decision was made after considering that the arguments presented both in the complaint and during the hearings “are based solely on assumptions, considerations” and do not meet the requirements.

In the Court’s view, the complaint should not underestimate significant aspects of the legal framework.

This decision can be appealed to a higher administrative court.

Andrius Cechanavičius, a representative of the Governing Chamber of the Kaunas Regional Regional Administrative Court, asked to investigate whether the procedure approved by the Kaunas City Council contradicts the legal norms and, if he does, to repeal the points of the procedure that link the care benefits. of children with the residence.

The Government representative filed an application with the court after the Kaunas City Council rejected his proposal to change the procedure for the payment of kindergartens.

He has said that the interests of various vulnerable groups in society have not been sufficiently taken into account in making this decision.

On October 15 last year, the Kaunas City Municipal Council decided that the daily rate for kindergarten, which reached 58 cents, has risen to 9.2 euros since January. Urban children are reimbursed this tax, so they continue to pay 58 cents, but parents whose place of residence in the city is undeclared have to pay the full price.

The city provided compensation at half the total price for those children whose only parent declared to the city.

The Kaunas District Municipality has approved the procedure whereby its residents attending kindergartens in the city will be compensated for the price increase. It is planned to allocate 864 thousand LTL for this purpose from the district budget this year. euros
