The Council of Judges recommended to the president to nominate Driukas and Tamošiūnienė to the SCL judges

The decree, which appealed to the Council of Judges, was signed by the head of state on Thursday.

E. Tamošiūnienė and A. Driukas were nominated as the best candidates for the presidency by the Selection Committee for Judges Candidates at the end of November.

The selection was made by the commission both for the post of LAT judge Janina Januškienė, which became vacant on July 5, and for another post, which became vacant from the others on January 8.

In accordance with the Constitution, SCL judges are appointed and removed by the Seimas on the recommendation of the president, with the advice of the Council of Judges.

A. Driukas has more than 36 years of legal work experience, he already served as a judge of the SCL in 1999-2003, at the beginning of his career as a judge he worked in the District Court of the city of Druskininkai, he was president for a long time of the Civil Cases Division of the Lithuanian Court of Appeal.

E. Tamošiūnienė, who has more than 23 years of legal work experience, has been a lawyer for a long time, since 2013 she works as a judge in the Lithuanian Court of Appeal, she was president of the Civil Cases Division of this court. She also has a doctorate and teaches students from the VU, a month ago she became a member of the Council of Judges, vice president.

Currently, there is also a selection for the position of president of the SCL. The judges who wanted to run for him in September were able to present their nominations, which were forwarded to the Presidency, which must decide whether to continue the selection procedure or resume the listing phase.

Jūratė Šovienė, the president’s chief legal adviser, previously told BNS that the Presidency intends to re-invite justices to run for president of the Supreme Court, but has promised to announce the decision only after filling the vacancies.

The decision of the presidency to announce the election for the office of president of the SCL in the absence of a full body of judges of this court has received criticism from some lawyers and politicians. Those who oppose the decision claim that it conflicts with both the Constitution and the Law of Courts, which stipulate that the president of the SCL is appointed from among all the judges appointed by this court.

This court has not had a president since August 31 of the previous year, when the Seimas decision to release Rimvydas Norkas from these functions came into force. He went to work for the Court of Justice of the European Communities in Luxembourg.

In the spring, G. Nausėda proposed to appoint Sigitas Rudėnaitė, President of the Civil Cases Division of the SCL, to this position, but the parliamentarians rejected her candidacy. He is currently in charge of the LAT on a temporary basis.
