The incident, which ended in an accident, took place on November 15, 2018 in the Mažeikiai district, on the section of the Anulynai – Tirkšliai highway near the town of Balėna, reports the Attorney General’s Office.
During the pre-trial investigation, data was collected that around 2 pm the school bus, which was taking the children home after school, stopped to drop off a child in Balėnai. The bus stopped with the warning lights flashing orange and visibility from the road was good. According to the study, when the student was discharged from the bus, he was in no rush to cross the road, waiting for the minibus to move and for better visibility. When the boy crossed the street from the Telšiai side, a car flew by at high speed, which may not have noticed the boy and allegedly obstructed him. The student died at the scene.
During the pre-trial investigation, it was established that the then doctor at Telšiai Regional Hospital, Mažeikiai District, was driving the car at a speed of approximately 149 km / h. member of the municipal council, former member of the Seimas S. The speed allowed on this section of road is 90 km / h, and according to the Road Traffic Regulations (KET), the driver must reduce speed, if necessary, and stop to overtake children and the person who accompanies them.
The driver was found to be sober at the scene. The man does not admit his guilt and claims that he did not exceed the speed limit. According to available data, S. Kaktys has been repeatedly punished for speeding.
The pre-trial investigation was complex and time consuming due to data provided multiple times and by different experts on the speed of the car at the time of the incident. On the defendant’s side, the data from a specialized automobile service computer were provided and the conclusion of a private accident expert that the speed at the time of impact was lower (around 94 km / h), so that the violation of S. the main condition of the accident. The specialists in the case were assigned various tasks, and the Lithuanian Forensic Science Center confirmed the significantly exceeded speed of the car during the impact and the mechanism of the traffic accident, which was a condition for the occurrence of the traffic accident.
During the investigation, complaints of violation of traffic or safety regulations were also made to the bus driver, who according to the KET, as a driver, was obliged to accompany a child under 10 years of age to the other side of the road, but not did. The investigation against the bus driver was terminated because criminal liability would have been possible if it had been established that the driver of the car who struck the child, S. Kaktys, did not violate KET requirements and the traffic accident was due to minor negligence and violation of the rules. According to the data collected during the investigation, the boy drove on the road in accordance with KET rules and the driver of the car violated them.
Immediately after the incident, the defendant met with the student’s parents, pending the outcome of the pre-trial investigation and the results of the investigation, and transferred € 15,000 to them in good faith.
The pre-trial investigation in this case was conducted by officials of the Telšiai County Police Chief Commissariat, and the investigation was conducted by the Telšiai District Prosecutor’s Office Prosecutor A. Laukaitis.
The case was transferred to the Mažeikiai Chamber of the Telšiai District Court. The Penal Code stipulates that any person who has violated road safety regulations while driving a road vehicle, if he has caused an accident that has caused the death of a person, will be punished with up to 8 years in prison.
