According to the court, before beginning the investigation of the evidence, lawyers for A. Bautronis and S. Mockevičius received a request in the case to return the charge to the prosecutor’s office. According to them, the accusation is written in the abstract and does not meet the requirements of the Code of Criminal Procedure.

Kaunas regional prosecutor Nomeda Urbonavičienė, who supports the state prosecution in the case, disagrees with this view of the accused’s lawyers.

Judge Vilma Dapkevičienė, upon hearing the case, accepted the request to return the accusation. The court will issue a written decision on this request on August 14.

The next meeting in this case is scheduled for September 9.

This case is separate from the ongoing large-scale pre-trial investigation into the fire that occurred in October 2019 at the Alytus Ekologistika company.

According to the Prosecutor’s Office, due to the inaction of the Alytus Fire and Rescue Service officials, no measures have been taken that could have prevented this fire.

According to the pre-trial investigation, the defendants did not classify this company as a group of objects to be inspected and did not include it in the annual planned fire technical inspection plans. This did not allow identifying the fire, locating it at an early stage and preventing its spread.

The pre-trial investigation also found that there had been nine fires at the company since 2012, of which Fire and Rescue Service officials were aware.

The fire at the Ekologistika tire recycling plant in the Industrial District broke out on the night of October 16 last year, with firefighters battling the fire and its aftermath for more than a week.

During the fire, due to air pollution, companies located in the city of Alytus did not work, public transportation did not work in the Industrial District, and some farmers in the Alytus District were unable to supply milk.

The factory director, Juozas Cicñas, and two other employees were suspected of violating the rules of maintenance or use of buildings containing potentially dangerous equipment or performing potentially dangerous work, as well as fraudulent accounting.
