71 members of the Seimas voted for him, there were 24 against him and they abstained equally. If approved after presentation, the draft will be further considered by Seimas committees and returned to the Seimas meeting room for consideration in the fall session.
The ruling conservatives, the Liberal Movement and the Freedom Party, which initiated the project, voted in favor of the project, while the opposition “peasants”, social democrats, “workers” and representatives of the Lithuanian regional faction abstained.
The project also received two votes from the minority side: Vytautas Bakas, a representative of the Mixed Group of Seimas members, and Andrius Mazuronis, a representative of the “working people”.
The governors who started the project say it is time to affirm that after the restoration of independence in 1990, Lithuania had a leader before the presidential elections, while opposition representatives accused the majority of rewriting history.
One of the initiators of the project, Seimas spokesperson Viktorija Čmilytė-Nielsen, said that the project is “a mark of respect and recognition for a person who played a unique role in the Lithuanian state.”
“It is time to appreciate the contribution of Professor V. Landsbergis, and I believe that this Seimas is precisely the Seimas who will have enough strength and wisdom to do so,” said V. Čmilytė-Nielsen when presenting the project.
“No one doubts that Lithuania was already an independent state at that time, today is a good time to recognize that Lithuania also had a leader at that time,” said the head of parliament.
He said that the submitted draft would declare that “the President of the Supreme Council from 1990-1992, as the highest official of the Republic of Lithuania, was the head of the restored independent state of Lithuania.”
Birmontienė: it will inevitably arouse passions
Former Constitutional Court (CC) judge, Mykolas Romeris University (MRU) professor Toma Birmontienė, said on the “Question of the Day” news radio show that we cannot appreciate our history and the people who deserve status.
“My opinion is that we do not appreciate people who deserve the state. And its merits are absolutely unique. Now we are talking about the head of state, here is a legal term, create some legal consequences. But we have more heads of state: and President Valdas Adamkus, Dalia Grybauskaitė, Algirdas Mykolas Brazauskas, I can continue to appoint our presidents. And there will be more of them.
But Landsberg is an absolutely unique situation. He’s the head of the Restorative Seimas, I’d say he’s the head of our restored state. This state is absolutely unique. And I am a little sorry that we are arguing with the doctrine of the Constitutional Court, looking for how to get to that CC again here, or through which window to jump. But we do not believe that we can create a law that is unique, for one person, “said T. Birmontienė on the radio news program” Question of the Day. “
He said that Lithuania would simply need such a law. And sometimes we can’t even judge our history.
“Look how difficult it is to build a monument. We took down the Soviets with ease. After all, that situation is historical, especially when we lose a person, it gets complicated, then everyone attacks their heads. We are not even able to appreciate our history ”, said T. Birmontienė, the interlocutor of the program.
T. Birmontienė stated that since the status of V. Landsbergis in the country was unique at that time, this issue should be addressed in a unique way.
The presidency said Tuesday that the solution to this problem is a certain state debt to V. Landsberg, which was tried to surrender earlier. T. Birmontienė predicted on the show that this problem would cause many passions.
“Although I agree with the opinion expressed by colleagues, a bill of this type, which is being presented, will continue to provoke discussions in the CC later on, since there will be those who want to try to transfer this issue to the political space. And the type of project that is now being proposed will inevitably awaken passions, it is not the end, it is just one more stage in that long debate. In my opinion, it would be better if a unique status was granted without trying to follow the path of assimilation, ”said T. Birmontienė.
Sinkevičius: Landsbergis will not assume the presidency after the approval of this law
Vytautas Sinkevičius, a professor at Mykolas Riomeris University (MRU) and an expert in constitutional law, stated in the program that Lithuania was already behind with this decision, according to him, this issue should have been resolved much earlier.
“When we say that the provisional basic law did not provide for a presidential institution then, it did not. This opposition is right: the presidential institution was not there then. But the provisional basic law later wrote that the president of the Supreme Council is the highest official in the country. It is necessary to distinguish two things – the position of the Constitutional Court in 2002 was as follows – only the person who was elected in direct elections as President of the Republic can hold the title of President.
Consequently, no one else can receive that title. The only way to do this is to go to the polls and win them. But in this case, we have a special situation, a special person whose status under the Provisional Basic Law in 1990-1992 was exceptional, both political and legal. And the powers that normally V. Landsbergis had belonged to the head of state, ”declared V. Sinkevičius on the program.
Vytautas Landsbergis
However, he requested the adoption of this law so that the situation at that time is significant.
“Why is it necessary to pass this law. It is necessary to make sense of the situation that has arisen by law. I totally agree with my colleague T. Birmontienė that those people who saw the events of that year, participated in them in one way or another, do not even think that V. Landsbergis was not the head of state ”, assured V. Sinkevičius .
He assured that the law is necessary to guarantee certainty and legal security.
“If such a law is passed, we will have a single one-man law and its functions will be called Chairman of the Supreme Council and first leader of Independent Restored Lithuania.” He will not become president after the passage of this law, the opposition is completely unnecessarily confused and doubts that Landsberg will be recognized as president. No “, V. Sinkevičius tried to dispel his doubts.
He said he believed that the Constitution did not prohibit the Seimas from passing such a law.
“I see no reason to say that such a law is in conflict with the Constitution,” V. Sinkevičius said on news radio.
Constitutional law expert V. Sinkevičius stated that finally a tribute should be paid to V. Landsbergis.
“Why are we going to go back to that law now and why is it necessary? We must not only pay tribute to the man who gave his whole life to Lithuania and worked at that turning point, ”he said on the show.
He explained that establishing continuity was crucial to him.
“Now I imagine that it is about the restoration of historical rectitude, the consolidation of historical justice, certainty and clarity. For me it is particularly important that this is the establishment of the legal continuity of the head of state as an institution. And we have to say, after all, there is no state without a leader, ”former judge V. Sinkevičius told the radio news program.
Meškauskaitė: I would like to wish such a miracle that the opposition rises above that opposition
The opposition raises another question: why is it trying to put this law on the Seimas agenda in the last days of the spring session, without much discussion? Liudvika Meškauskaitė, Professor of Law, Vilnius University (VU).
“I think this issue is not only legal but also political, it is not new. This has been talked about many times. Perhaps my opinion is subjective. (…) I would call on the opposition, if they say that they are guided by the ruling power, I would suggest that they be guided by wisdom. However, whatever we say, he is Lithuania’s brightest personality. And I am not at all surprised that such a personality causes such storms of emotions. There is a large group of people who love Landsberg, maybe even too much. And there are also a lot of people who hate him, ”said L. Meškauskaitė about the division of society and the problems of this personality.
He considered that a strong personality operating at a real tipping point evokes very different emotions.
L. Meškauskaitė also addressed the opposition and asked for a greater agreement on this issue.
“I want to believe today, I would invite the same opposition to be wise. We have too much resistance and such a wise move to give the royal manager the status that he has actually earned. And overcome the waves of hate, excessive love and pay tribute to the man who has given so much to Lithuania at a crucial moment, ”he explained.
Lawyer L. Meškauskaitė stated that this issue is very important now and that he feels a lot of public opposition.
Vytautas Landsbergis
“When there is an obvious void of personalities. And internationally, it would also be a significant step, “said L. Meškauskaitė.
The interlocutor of the show recalled that the decline in opposition to the rulers means weakness.
“It just came to our attention then. I would like to believe and wish for such a miracle that the opposition rises above that confusion and resistance. Maybe she can mobilize us in the future. For showing those ambitions that the law was not passed on time, that the entire nation was not elected. But we all remember perfectly ”, said L. Meškauskaitė, interlocutor of the radio program News” Question of the day “.
Delphi recalls that an attempt has already been made in the Seimas to grant the status of head of state to V. Landsbergis during the last term, but the initiative of the then president of the Seimas Viktoras Pranckietis did not have the political support of the former rulers.
