On Thursday, Seimas intends to consider and decide on the nominations of Giedrė Lastauskienė, Andrius Kabišaitis and Algis Norkūnas to serve as CC judges.
On Wednesday, the issue of the appointment of judges was considered by the Law and Order Committee of the Seimas. The members of the Committee did not approve the candidacy of A. Kabišaitis, Head of the Legal Department of the Seimas Chancellery, proposed by the President of the Seimas to the judges of the CC. His candidacy was supported by only three members of the committee, with the abstention of 5 parliamentarians. At that time, the committee approved the candidates proposed by President Gitan Nauseda and the President of the Supreme Court of Justice.
E. Šileikis: Deplorable manipulations are taking place in the Seimas
According to E. Šileikis, the fact that the Law and Order Committee did not approve the candidacy of A. Kabišaitis is not a coincidence. According to him, if the candidacy of A. Kabišaitis in the Seimas is rejected, the current president of the CC Dainius Žalimas will remain in the position of president for several more months.
“The intrigue is that the current president of the Constitutional Court, who as a candidate rotated the judges of the CC in 2011 presented by the then Speaker of the Seimas Irena Degutienė, in the current rotation is related to the candidacy of A. Kabišaitis presented by the Speaker of the Seimas. If it is rejected, the competent judge of the CC (proposed by the previous president of Seimas in 2011) will remain in office in accordance with the Constitutional Court Law. He has been since 2014. In addition, he is the president of this court, making him the “central figure”, although formally “the first among equals,” says E. Šileikis in an open letter.
“After the Seimas elects the other two candidates as Seimas judges by secret ballot, the current person, who is very close to the majority of the Seimas, not only because of his worldview, but also because of his previous long-term membership term in the respective political party (the only characteristic that is not common to almost all the other judges of the Lithuanian courts) ”, says the professor.
The professor also does not rule out the possibility that the new candidate of the current Seimas V. Čmilytė-Nielsen could be rejected by Ingrida Danelienė of the previous Seimas.
„V. The new Čmilytė-Nielsen candidate can be Ingrida Danelienė, who was rejected by the previous Seimas, or a person of adequate character (views) close to certain people / politicians ”, considers E. Šileikis.
According to the VU professor, if the Seimas does not approve the three nominations for the CC on Thursday, the new CC president can only be expected in April.
“If A. Kabišaitis is rejected by secret ballot in the plenary session of the Seimas on the recommendation of the committee of the Seimas mentioned above and a new candidate is appointed in February, March or April of this year, the current president of the CC 6 months, until the majority of the Seimas is interested, among other things, dissatisfied with certain sensitive personalized historical political aspects, which in the past were appropriately (allegedly unduly) evaluated by the CC during the presidency of Prof. Egidijus Kūris “, says E. Šileikis.
