3. Is an SDK required for a motorcycle, trailer?

An SDK is required for all motor vehicles and their trailers. Therefore, an SDK is required for both the motorcycle and the trailer.

4. What happens if the buyer delays in declaring the acquisition within the allowed time?

In this case, both parties have an interest in declaring the transaction as soon as possible. The buyer so that the property is declared in his name and the seller loses responsibility for the misconduct committed by another person.

We advise clients to protect their interests in advance. For example: to finally pay for the car or hand over your keys to the buyer only after both parties have declared a change of ownership.

5. Do I have to register the vehicle after receiving the SDK?

If there is no intention to participate in public traffic, the car does not have to be registered.

If you intend to participate in public traffic, the car must be registered. Please note that if the car has been previously registered in Lithuania, it must be done within 10 calendar days after the declaration of change of ownership. Otherwise, the car will be canceled automatically.

6. What happens if the seller confirms the transfer but the buyer does not register the vehicle and it is in transit?

10 calendar days after the confirmation of the transfer of ownership, the car is deregistered and participation in traffic is not possible. Failure to comply with this obligation will result in administrative liability.

7. If the transaction is overseas, don’t I need to get the SDK?

If you are a resident of Lithuania, in all cases, when buying and selling vehicles both in Lithuania and abroad, you must declare the change of ownership in the Registry. In case of purchase, an SDK will be delivered to you and, in case of sale, canceled.

8. Does the vehicle with registration plates have an SDK?

Yes, vehicles with license plates must have an SDK because they were imported into Lithuania and are owned or sold in Lithuania.

9. What happens to the SDK in the event of the death of the vehicle owner?

In the event of the death of the vehicle owner, the SDK will remain in effect until requested by the heir. You will file a statement of acquisition and a new SDK will be provided to you.

10. Does the heir to the vehicle have to request a new SDK if he intends to sell it to someone else?

Yes, the heir must in all cases request a declaration of change of ownership and obtain a new SDK. The vehicle can then be registered in the heir’s name or sold to someone else.

11. Why do I need to obtain an SDK before importing a car from abroad? Will the person be able to “cross the border”? What are the penalties?

Such condition is established in the Road Safety Law.

The owner must receive an SDK before the car enters the territory of Lithuania.

The control agents, if they find a violation, can impose a fine on the owner of the vehicle for non-compliance with the established requirements of 150 to 300 euros. In case of repeated infringement: from 440 to 600 euros.

12. If the vehicle is rented, who should receive the SDK? Bank or manager?

SDK is the owner’s declaration code that is given to the vehicle owner. When a vehicle is rented, the bank or leasing company becomes its owner and the buyer becomes its manager. So this means that the bank or leasing company must obtain the SDK.

13. What if the vehicle is owned by two or more owners? Will they get the same or different SDK?

An SDK will be created, but each acquirer (eg, buyer, heir) will have their share of ownership based on the information in the acquisition documents.
