Prosecutor General Pašilis has been selected as a candidate for the General Court of the EU

“Selected. We selected this morning,” the minister told BNS on Thursday.

The representative of the Attorney General, Elena Martinonienė, informed BNS that E. Pašilis will not provide any comments yet, as the selection process has not yet been completed.

According to E. Jankevičius, the selection committee consisted of representatives of the Seimas, the Government and the Council of Judges, and the candidacy of E. Pašilis was approved by a large majority.

“By a vast majority, not entirely unanimous, but almost,” he said when asked about the results of the vote.

The appointment of E. Pašilis will be submitted by the Ministry of Justice to the Government for approval, and must also be approved by President Gitanas Nausėda and the Seimas.

“The president will have to decide, I communicated a bit with the advisor, as if the feedback was positive, but I cannot say if he will confirm or not. The president will evaluate all the pros and cons and make a decision, “said E. Jankevičius.

According to the Minister of Justice, if the president approves the candidacy of E. Pašilis, the Seimas of the new term will probably have to vote for her.

“It is definitely not the case that we are in a hurry that it is the elderly who go there, it is necessary to select a candidate there. Anyway, it is only necessary to select a candidate, because it has been a year now, “he said.

The ministry also announced the selection for this position in June, when five applications were received, but the commission could not decide on the most suitable candidate. Six candidates participated in the selection announced last week and had five days to present their candidacies.

According to E. Jankevičius, jurists and judges participated in the selection, E. Pašilis currently occupies the highest positions.

Once E. Pašilis has been approved as a candidate by the Lithuanian authorities, it will also have to be evaluated by an evaluation committee in Luxembourg.

Rimvydas Norkus and Virgilijus Valančius, a former judge of the Supreme Court of Lithuania (SCL) appointed last year with the approval of the Seimas, are currently working at the General Court of the EU. Although the term of the latter judge ended in October of last year, to this day he has been working due to disagreement over a new candidate.

So far, two candidates for this court have been rejected: last January, the candidacy of the then Constitutional Court judge Gediminas Mesonis was approved by the Seimas, and was rejected by the Luxembourg evaluation committee. At that time, the Government’s proposal to extend the presence of V. Valančius in court presented in July last year was not supported by President Gitanas Nausėda for another term.

The General Court of the EU mainly hears actions against acts of the EU institutions, including actions brought by states against the European Commission. Judges are appointed to this court for a period of six years.

E. Pašilis was appointed Prosecutor General for a period of five years at the end of December 2015. Until then, he served for 15 years as a judge of the Ukmergė District Court, five of them as president of this court.
