The court decided to impose a sentence of 3 years and 6 months in prison on Marius M. (name until sentence entered into force, changed – aut. Past). At the same time, the execution of the sentence was postponed for three years. So if the man who caused the tragic accident does not commit a crime during this period, he will be able to avoid imprisonment.

Marius M. is obliged to start work or study during the postponement of the execution of the sentence, not to leave the city (district) of the place of residence without the permission of the institution that supervises the convicted person and not to use psychoactive substances.

You have also been banned from driving road vehicles for 3 years. The judgment can be appealed to the Vilnius Regional Court within 20 days from the date of its publication by filing an appeal with the Vilnius City District Court.

According to the case, Marius M. was driving his BMW while intoxicated. You violated the requirements of traffic rules, resulting in a traffic accident that killed one person.

The accident occurred in 2019. October 30, around 8.15 pm, in Vilnius, Lentvario Street. Marius M. was slightly drunk that night: 0.90 per thousand of ethyl alcohol was found in his blood.

Driving in the only traffic lane of Lentvario Street in the direction of your movement from the Mūrinė Vok the side in the direction of Bališkės, during the dark hours of the day, on a stretch of road without lighting, you exceeded the allowed speed.

Where 50 km / h is allowed, Marius M. drove more than 97 km / h. velocity. However, a fatal danger awaited the driver and 19-year-old passenger at that location.

At a turn in the street, the BMW driver was blinded by the headlights of a car traveling in the opposite direction. However, Marius M. did not change direction or slow down, but instead attempted to maneuver.

However, exceeding the maximum speed limit made BMW unmanageable and went off the road. BMW then collided with a tree growing on the right side of the road. The car was mutilated, split in half.

The blow to the tree was fatal to a young BMW passenger. Doctors still managed to get him to the hospital, but the boy’s life could no longer be saved.

Marius M. pleaded guilty in part. He said that the same day with 19-year-old AM (later a friend who died in an accident – Past car) was in the body of a friend in Lentvaris. The man said that he normally did not drink alcohol, but that he drank 4-5 glasses that day.

After the corpses, Marius M.’s uncle took them away and took them home. But then two friends received an invitation to go with another friend. Marius M. said he felt good so he got behind the wheel of a BMW.

The man admitted driving at 90-100 km / h. velocity. Usually he does not accelerate, but that day after the body felt that he was not himself (due to the loss of a friend).

As he was driving, the light from another car began to shine in his eyes, and he noticed that car as he approached the curve of the street.

Marius M. said he woke up somewhere after 40 seconds and saw that there was nothing left of the car, it was in pieces, broken.

He then unbuckled his belt and walked out, seeing that there was no 19-year-old MA around, even though he was wearing a belt. Then he saw that the buckle was at the seat belt junction, but the belt itself was cut off.

The driver started looking for AM and found him on the sidewalk. His friend was still conscious and was telling him something about the cold.

Neither the driver nor the witnesses moved him because the 19-year-old was seriously injured. Someone called an ambulance, then officers arrived.

Marius M. recalled that he had recovered alone in the hospital, his arm and head had been sewn up and then he learned that his friend had died. With a friend who had killed, Marius M. had existed for about 10 years, they were neighbors, good friends.

I bought the car just before the accident

It turned out that Marius M. had bought the car with which the tragic event had taken place 3 months before the accident, the technical inspection had already been carried out, but he still visited the car repair shop because several parts had been damaged.

One time the car was transported for inspection and the next for handling. Chassis and gearbox issues were identified. The inspection also found that there were layers of paint larger than allowed on the door where the ceiling was stored.

The mechanic told Marius M. that the car had been “swept”. While operating the car, I noticed that something was wrong with the suspension and gearbox of the car because it kept throwing errors, the alarm went off and I could no longer drive.

So he had to remove the discarded bugs every 2-3 days. Later it became known that the car could have been welded with various machines. According to the driver, if this had not been done, his 19-year-old friend probably would not have suffered fatal injuries.

Not only that, the side airbag did not inflate on the roof where AM was sitting. At that point, the driver’s side airbag deployed on both the steering wheel and the roof.

The child was left without a father

Marius M. apologized to all of the victim’s family he met after the incident. He also paid for a friend’s funeral, taking care of his daughter. She promised that those under 18 would always help her.

The girl who lost her beloved and the boy’s father also told about the help of Marius M. at court. He said that he communicates with the defendant, Marius M. helps his son, buys food, things.

The girl said that she did not feel angry with him, only interacted with him. M. doesn’t talk much about the accident with Marius, because it still pains me to remember such an accident.
