“The entry into force of this law will allow Lithuanian citizens to decide for themselves which state they want to be citizens of. This question remains relevant when parents leave Lithuania. We have several examples of young people who have grown up in other countries and want to return and recover the citizenship of our state ”, says the Minister of the Interior, Agnė Bilotaitė.
Until now, only children who acquired multiple citizenship (Lithuanian and other states) by birth were entitled to multiple citizenship.
Acquisition of citizenship of another state must be notified to the Department of Migration or the diplomatic mission or consular office of the Republic of Lithuania within two months. You are invited to do so through the Lithuanian Migration Information System (MIGRIS).
After acquiring multiple citizenship until the age of 18, these people will retain it and reach the age of majority, the report from the Department of Migration says. If children who have acquired Lithuanian citizenship by birth subsequently lose it, they will be able to regain Lithuanian citizenship by filling out an application through the Lithuanian Migration Information System.
The amendments to the law also stipulate that children of stateless persons who legally reside in the Republic of Lithuania, or children whose parents are stateless and legally reside in Lithuania, and the other is unknown, will acquire citizenship of the Republic of Lithuania at birth. . The citizenship of the Republic of Lithuania of such children will be recorded on the document confirming the birth of the child at the time of the registration of the child’s birth at the civil registry office.
The amendments to the Citizenship Law also modify the citizenship procedures.
From 2021 January 1 Individuals will submit all applications for the granting of citizenship of the Republic of Lithuania (naturalization, simplified or exceptional procedure), return and conservation through an institution authorized by the Government of the Republic of Lithuania, that is , the Department of Migration. These requests can be submitted quickly and conveniently through MIGRIS.
In cases established by the Government of the Republic of Lithuania, persons permanently residing abroad will continue to be able to submit applications for citizenship of the Republic of Lithuania in person through diplomatic missions and consular offices of the Republic of Lithuania, according to the Immigration department.
According to the law that will come into force, granting citizenship of the Republic of Lithuania to children by naturalization will exempt them from the requirement to pass an exam in the language of the state and the basic concepts of the Constitution of the Republic of Lithuania and of have a legal source of support. Furthermore, children and persons declared incapacitated by a court will be exempted from the requirement to take an oath to the Republic of Lithuania.
The Department of Migration observes that since January 1. the time period within which individuals will be obliged to renounce citizenship of another state upon becoming citizens of the Republic of Lithuania – 1 year from the oath to the Republic of Lithuania or when no oath is required (for example, children under the age of 18 years) – 1 year from the presidential decree granting citizenship of the Republic of Lithuania or the effective date of the refund. This one-year period may only be extended in exceptional cases and for a maximum of 1 year.
Citizens who swore the Republic of Lithuania until 2021 January 1 without renouncing citizenship of another state, documents on the loss of citizenship of another state must be submitted to the Migration Department by 2022. January 1 Failure to comply with this duty will result in the loss of citizenship of the Republic of Lithuania.
