Lawyers warn compatriots who like to argue: officials now have more power

In the capital, when officers detained an anti-quarantine protester in Lithuania, the former detainees around the detainee were angered by the police; The uniformed men allegedly took the man out of the car unnecessarily and broke their hands. And on Friday, the rage did not end there.

A conflict between police officers and a man who disobeyed them took place on Gediminas Avenue, near the Seimas building. In less than a week, a video of this conflict has been viewed tens of thousands of times online and has received highly controversial reactions: Some people are cursing officials as if they are always being brutal. Others contend to officials that their actions were legal.

The rights and obligations of police officers and the use of sanctions are enshrined in the Police Law.

“Among them is the right to demand the presentation of documents, both identity and vehicle. Officials have the right to detain people, take them to the police station and many other rights,” says MRU lawyer Doc. Dr. Andrei Novikov.

“A claim by a legal official is mandatory if a person does not comply; in principle, it is sufficient to warn the official once that if his legal requirement is not met, he will use force,” says police representative Ramūnas Matonis.

The man, who refused to provide the documents to the police, repeats that the officers did not appear. But the police distributed videos that deny it.

“The officials actually showed up, they hit the service card, they said their first and last name, but the person pretended he didn’t understand what the officials were.” He started demanding the removal of the masks and started insulting the officials, “says R. Matonis.

“It is advisable that people do not argue with officials, that they follow their legal instructions. And if they think that their rights have been violated, or have been subjected to excessive coercion, simply after all contacts with officials, they turn to lawyers and , in the circumstances, they hope to defend their rights in court, “Assoc said. dr. A. Novikov.

“We really urge our officials to be determined, to not engage in lengthy discussions, to politely say what causes a person to be detained, to repeat several times if a person fails to comply with legal requirements, and to simply take coercive measures and apply the law. Officials really don’t have time to explain to each person for an hour, “says R. Matonis.

Officials, according to lawyers, legally acted on the situation, and a person who did not listen to them has already been punished.

Another record circulating on the Internet, when a fisherman who does not want to wear a mask, is arguing with border guards and filming everything, caused anger among officials these days.

At first glance, it may appear that border guards are clinging to the fisherman unnecessarily in a remote location rather than in public, but this is not the case.

“Officials noticed a group of 4-person fishermen. They were all almost one in a platoon. The place is public: it is on the outskirts of the Plaškiai settlement by the Gėgė river. One of these 4 was without a mask. And the officers simply made a note to the person to put on the mask, since they are on all fours, subject to quarantine. The person reacted very inadequately to the comment: he evicted the officers, he fled from them, “says Bronislav Burzdžius, commander of the Plaškiai border guard of the SBGS Pagėgiai team.

And only then did the silly fisherman movie come out of his car, demanding that officials introduce him to laws establishing an obligation to wear a mask.

“Ignorance of legal regulation does not release liability for violations. It should be noted that border guards are also public administration officials: they have the right to impose sanctions, their instructions are mandatory. And if such officials resort to a person with imperative instructions , each person must respect them and comply with the requirements, “says Doc. dr. A. Novikov.

The truth here, the officers acted extremely humanely: they did not punish the arrogant fisherman, although they could handcuff them.

Lawyers warn compatriots who like to argue with officials that there is currently an administrative-legal regime in the country due to quarantine, so officials have even more powers to ensure order than usual.
