The CC recognized on Friday that the establishment of the maximum age for censorship is not considered in itself discrimination on the grounds of age prohibited by the Constitution, since such provision, according to the CC, pursues a constitutionally important objective: to ensure quality . of higher education.
The CC also recognized that the provision of the Statute of Vilnius University (VU), which stipulates that “professors and researchers (artists) over 65 can work at the university, if the Senate agrees to enter into a contract of Fixed-term work with them for no more than 3 years against the Constitution.
According to the CC, the Statute should establish general criteria according to which the Senate decides whether to approve the conclusion of fixed-term contracts for teachers and researchers over 65 years of age.
ELTA recalls that the petitioner addressed the Constitutional Court regarding compliance with the controversial legal regulations with the Constitution by suspending the civil case pending appeal, in which the controversy over the recognition of the dismissal of the petitioner as illegal arose. The plaintiff addressed the court on the grounds that he had been fired on the grounds of age.
