The culprits can be several
Mindaugas Statulevičius, President of the Lithuanian Real Estate Development Association (LNTPA), stated that a thorough and detailed investigation should be carried out in each case.
“Examples of such disasters, as happened in Latvia several years ago and there has been an incident of this kind in Vilnius, then such investigations take a long time. The responsibilities can be very different, from the designer, architect, builder, contractor, maintenance company and the like, ”said M. Statulevičius to the tv3.lt news portal.
According to the interlocutor, a case-by-case investigation would determine whether one or more companies that contributed to the construction or maintenance of the building were to blame for the collapse.
The apartment building on Gabijos Street, from which residents were evacuated on Monday, was built in 2004. According to M. Statulevičius, according to legal acts, certain warranty periods are provided: up to 5 years for all visible works , up to 10 years for hidden works and up to 20 years for the guarantee if violations committed intentionally are identified.
“The first and second guarantees would cease to be valid, the third guarantee, if it is established that they were intentional infringements and caused some deformation that caused the collapse, then it would be clarified who is responsible and who should compensate. I don’t know if the companies that designed and built that building are still on the market and there is something to be taken out of it, ”said M. Statulevičius.
According to him, if in the event of an accident it was determined who was guilty of the violations, the perpetrators could also turn to the perpetrators for the damages suffered.
Claims that mandatory property insurance would help
According to M. Statulevičius, if the worst case scenario occurred, the collapse of an apartment building, residents would be compensated differently.
According to the president of the LNTPA, a part of the population that has taken out a home loan must insure their home against destruction, so the damage suffered by them would be compensated by the insurance company. Homes not insured against destruction, according to the interlocutor, must be compensated by the perpetrators of the disaster.
“If there are no culprits, there is no legal entity responsible for it, then there are legal nuances. Either it would be aimed at natural persons, or there wouldn’t be very specific things here ”, said M. Statulevičius
According to him, the safest thing would be to insure the property, which does not cost much, but protects from surprises.
“Compulsory real estate insurance is not legal in our country, unlike vehicles, it may be worth considering, since it would provide more security, especially for those buildings that have already lived a certain life cycle,” said the interlocutor.
In case of disaster, housing for disadvantaged people
Modestas Rudys, Acting Head of the Vilnius City Municipality Civil Protection Department, stated that residents of apartment buildings, together with the house or community manager, should constantly monitor the status of the building and communicate with the house manager if they notice even the slightest problems or deformations.
“In turn, in the event of an emergency in an apartment building, the municipality first of all makes efforts to protect the residents of the house. Immediate care is taken so that people do not become homeless overnight and have time to put their house in order, ”says a representative of the municipality.
According to him, in the initial stage, as happened Tuesday with an apartment building on Calle Gabijos, residents are immediately provided with accommodation in a hotel or other place provided by the municipality, if they do not have the opportunity to temporarily stay with relatives. . “If the findings of the experts show that the building is suitable for their use, residents are informed about the possibility of returning home. However, if it is not possible to ensure the safety of the population in the building, housing will be provided free social services for socially disadvantaged people. Other neighbors are asked to take charge of renting the house on their own or staying with their relatives, “said the municipal representative.
