Gentville on banning smoking on balconies: this is a broken law

“It just came to our attention then. But what is essential for me as a liberal is another. Laws should not be passed in such a way that … the will of a person is sufficient to prohibit smoking on the balconies of the house.

Yes, I think there should be no democracy in a democracy where there should be a culture of agreement and not a culture of denunciation. A culture of veto is emerging here on the basis of a complaint, ”he told Knowledge Radio on Wednesday.

E. Gentvilas also pointed out that the legal ban on smoking on balconies is not fully thought through and resolved.

“The second (this law is ELTA) is not resolved physically. It turns out that smoking is allowed on the stairs – it is not prohibited, (…) and on the balcony – it is prohibited, ”he said.

Finally, the Elder of the Liberal Group emphasized that similar decisions should be made by consensus of the apartment blocks.
“Apartment communities make decisions collectively … – let’s leave them the right to agree on smoking on the balconies and not leave it to the dictatorship of one person,” said E. Gentvilas.

According to the amendments to the law passed by the outgoing Seimas, smoking is prohibited from January 1 on the balconies, terraces and loggias of apartment buildings owned by individual owners, when at least one resident of the house objects to smoking . The law also stipulates that the owner of a building (apartment) or another natural person who uses the building (apartment) and smokes in it must ensure that tobacco smoke does not enter the premises of another owner’s building (apartment) and in the same apartment facilities.
