The possibility of submitting an application in Lithuanian missions is provided for in the Law on the Legal Status of Foreigners as amended on August 10, but in practice it does not apply until the Ministry of Foreign Affairs has adopted a legal act of execution.

The amended law stipulates that in case of an emergency situation, asylum in Lithuania can be applied for at border checkpoints or transit zones, as well as on the country’s territory when legally entering, and in a foreign state on diplomatic missions. or consular. posts of the Republic of Lithuania.

Until now, the law has generally provided for asylum applications to be submitted at the border control points or on the territory of Lithuania to the State Border Guard Service or the Migration Department.

Deputy Interior Minister Arnoldas Abramavičius said this week that asylum applications were never submitted at border controls. He attributed this to the actions of Belarusian officials on his side.

“The Belarusian border authorities or services simply do not pass them through the border crossings. One thing, they have to have identity documents, another thing, the regime would then prove that they are the cause of illegal migration,” said the deputy minister.

The law also provides an exception according to which certain foreigners who have crossed the border illegally can apply for asylum, taking into account the “vulnerability or other individual circumstances” of the foreigner.

As Lithuania has grappled with flows of illegal immigrants in recent months, a reversal policy was introduced in early August: immigrants who crossed the country’s border illegally are ordered to return to Belarus.

According to data from the Ministry of the Interior and the State Border Guard Service, approximately 2.2 thousand LTL were reversed during this period. migrants, about 80 people were admitted.
