According to the peasants, the proposed projects have the same objective as the decriminalization of small amounts of all the drugs of the Freedom Party currently under discussion in the Seimas – to allow people to avoid the consequences of the Penal Code if they use drugs or psychotropic substances. . occasionally, in small amounts, over time or otherwise. dispose of them for their own needs and agree to treat addiction to drugs or psychotropic substances (in the case of a diagnosed addiction) or agree to attend and attend courses on harm from narcotic and psychotropic substances in accordance with the procedure established by legal acts in case addiction is not diagnosed.

According to Seimas member Agnė Širinskienė, the projects presented propose to extend the conditions of exemption from criminal liability and termination of the pre-trial investigation, since currently the exemption from criminal responsibility and the termination of the pre-trial investigation do not apply to some acts. to dispose of small amounts of drugs for one’s own needs.

According to the parliamentarian, such acts are mostly perpetrated by young people, they are episodic, related only to self-consumption, the possession of small amounts of drugs.

“Now there is no possibility, for example, of ending a pre-trial investigation if a person has sent a small amount of drugs for their own use and realizes that they have behaved inappropriately and starts addiction treatment.” Our projects provide for that possibility of ending the pretrial investigation. Of course, we have also put safeguards in place to ensure that the right is not abused: if the decision is made to suspend treatment, the pre-trial investigation will automatically resume. The pre-trial investigation would also resume in the event of a repeat offender. In addition, persons already convicted, repeat offenders, persons who have been subject to the termination of the pre-trial investigation in the past, but who have repeatedly committed the same acts, cannot request the termination of the pre-trial investigation or release. of criminals. responsibility, ”says Agnė Širinskienė, the shadow justice minister.

The “peasants” of the Seimas hope that the projects presented will be considered together with the legal acts that legalize the decriminalization of drugs and will receive the support of the members of the Seimas.
