The Building Inspection warns that building without a valid SLD when it is mandatory is called arbitrary and is prohibited.

One of the most recent violations detected by the Building Inspectorate at the end of April was the arbitrary construction of a residential house in Bendori, Vilnius district.

During the planned raid, checking the legality of the construction of various objects in that area, it became clear that the construction of a two-story one-story house on Ilgoja street was illegal.

According to the construction permit data and the Republic of Lithuania Infostatyba state construction supervision supervision, the builder UAB Rangos Guru has submitted an application to the Vilnius District Municipality Administration to issue an SLD for a residential construction project (of two apartments). , but in this case no mandatory document has been issued.

The Construction Inspection recorded all the main load-bearing structures of the buildings, i.e. the foundation of the posts of both apartments, the main structures of the building, the retaining walls made of silicate blocks, the finished monolithic ring, the overlapping roof , the full load carrier. roof structures (masonry) a layer of ground with vegetation excavated in the area.

An arbitrary construction act, a mandatory order not to perform any construction work, and a mandatory order to remove the consequences of arbitrary construction have been written to the builder.

It should be noted that the Law of State Supervision of Land Management and Construction establishes that a mandatory order to eliminate the consequences of arbitrary construction is an executive document executed in accordance with the procedure established by the Code of Civil Procedure.

If the mandatory order is not complied with, is partially or incorrectly executed, the Construction Inspection will send the mandatory order to the bailiff for its execution (except in the cases provided in Paragraph 2, Item 6 and Paragraph 7 of article 14 of this Law). ).

How the builder violated article 27 of the Construction Law. 1 d. 1 p. and 22, a protocol of administrative offenses will also be drawn up. According to article 56 of the Construction Law. 3 d. (1), the builder is subject to a fine of between 2 000 and 9 000 EUR for the arbitrary construction of a new non-special structure.

The Construction Inspection draws attention to the fact that arbitrary construction violates the rights of co-owners, administrators of adjacent parcels, can cause damage to the environment and a threat to human safety. Illegal construction also creates complex social, economic and legal problems, violates the principles of sustainable development and rational urbanization.

These activities often destroy cultural values, damage natural resources in protected areas, do not guarantee the security of biodiversity, and limit the population’s ability to meet recreational and cognitive needs.
