Conflict in Vilnius: a pedestrian threw a bottle in a car, the driver “returned the money” with a broken jaw

Opel Zafira driver Aurimas R., who was not expecting such a blink, stopped, drove backward and hit him in the face as he approached the pedestrian. Then he got in the car and drove off. The victim said he had thrown a plastic bottle because the driver almost broke it.

Vilius U., who felt the pain of the blow, called the ambulance. Doctors discovered that the man suffered a fracture of the left side of his lower jaw. And when they discovered the cause of that fracture, the doctors reported it to the police.

Thus, Aurimas R. was found in the defendant’s bench and Vilius U. in the bench. After examining the case, the Vilnius City District Court found Aurima R. guilty of violence and sentenced her to a prison term of one year and 6 months.

During the entire sentence, the convicted person is obliged to continue working or register with the Employment Service without offenses and not to leave the city (district) of the place of residence without the permission of the institution that supervises the convicted person.

You will also have to pay a contribution of € 500 to the Victims Fund. Aurimas R. was also fortunate that the victim had not filed a civil claim for moral damage. Otherwise, his reckless action would have cost even more.

Guilt was partly admitted

The conflict between these individuals emerged in 2019. October 19, at approximately 8 o’clock, Naujininkų Street, Vilnius. In court, the defendant Aurimas R. admitted his guilt only in part. He said he was driving an Opel Zafira.

Upon entering Naujininkų st. there is a road where there is no intersection or traffic light when turning. According to Aurimo R., it is not possible to drive there quickly because there is a sharp turn to the left where you almost have to stop.

Turning onto Naujininkų Street, Aurimas R. entered the intersection and saw the victim there. He said he stopped and missed the hike and then started driving. But after driving about 3-4 meters he heard a bang.

He saw a bottle fall through the ceiling. As he passed the victim, Aurimas R. saw that she was carrying a purse in one hand and a bottle in the other. When the victim threw that bottle, he did not see it, he only saw it roll off the roof of the car.

Such pedestrian behavior proved inappropriate for the driver. He stopped, got out of the car and asked the victim “what is it, why did he do it?” Apparently he started to say something in uncensored words and aggressively walked towards the driver.

The driver said the pedestrian was big, he was afraid he would be hit. As soon as the victim approached, the driver himself struck him with a blow to the side of the head, then he sat in the car and drove off. It all took about a minute.

The driver said in court that he did not really threaten the victim. He denied saying that he would “break his mouth next time.” The driver stressed that he only recognizes the impact. He said it might not have been necessary to do so, but simply to call the police.

Another version of the event

Vilius U, who was recognized as the victim in the case, presented a slightly different scenario and said that he went home that morning. He was carrying a 1-liter bottle of mineral water with about 250 ml remaining, and in his other hand he carried a large bag.

Vilius U. said he was entering the carriageway from the road, he was almost in the middle when he heard the car approaching. The man thought he would miss him, but the driver, according to Vilius, on the contrary, only increased his speed.

Since the return to his car was about 50 meters away, his speed could be 30-50 km / h. The defendant passed in front of him, did not stop passing him, and barely crossed his leg. Then Vilius U. angrily threw the bottle he had in the car.

The bottle flew off the roof of the car. The machine stopped only after the bottle was thrown away. Then the car backed up, approached the driver to ask “how do you drive?”

Vilius U. recalled that as he walked to the car, he asked “who taught you to drive like this?” The driver sat in the car after the impact and drove off. Vilius U. stated that he was sober during the event. The blow hit him in the jaw and he called an ambulance.

An ambulance that arrived asked what had happened, he told me and the doctors called the police and took him to the hospital. The event was around 8pm in the morning, it was quite light, but there was nothing around, the street was empty.

However, the court had enough witness testimony and collected evidence to convict Aurima R. and sentence her to a year and a half in prison.
