“I appreciate the fact that the magistrates of the Constitutional Court were not approved when they should have. Last spring, the ruling Seimas harshly and without argument rejected the three candidacies for the Constitutional Court, and the faction of the Liberal Movement criticized him harshly. Therefore, I now positively approve the decision of the Seimas to approve at least two of the proposed candidates. In this way, the Seimas corrects the legal nihilism of the previous legislature and almost completes the renewal of the Constitutional Court, ”V. Čmilytė-Nielsen told Eltai.
On Thursday, the Seimas supported the candidacy of the president proposed by Giedrė Lastauskienė and the president of the Supreme Court for the judges of the Constitutional Court. At that time, the Seimas did not approve the candidacy of Andrius Kabišaitis presented by the President of the Seimas to the judges of the CC.
The former president of the Seimas Viktoras Pranckietis intended to nominate A. Kabišaitis to the Seimas, who had already completed his work. V. Čmilytė-Nielsen explains that the same candidacy was presented in the newly elected Seimas as an attempt to maintain continuity between the two legislatures.
“It is a real shame that only a few votes are missing to fully implement this parliamentary duty. It must be recognized that the unsuccessful candidate turned out to be unfit for the Seimas. I nominated him in an effort to maintain the position of President of the Seimas and the continuity of the work of the Seimas between terms. I think that otherwise I would have shown a lack of respect both for Seimas, as an institution that implements constitutional duties, and for the candidate himself, ”said the politician.
ELTA recalls that in the spring the Seimas of the previous composition rejected the three nominated candidates for the CC judges. As a result, the rotation of CC judges is delayed by almost a year.
The rulers wanted to postpone the silence of the CC judges a little longer due to the alleged overload and risk from COVID-19, but the opposition collected signatures to vote for new judges of the Constitutional Court in the extended autumn session.
