According to him, none of the interviewed witnesses confirmed the information that A. Klimavičius had misappropriated the money belonging to the basketball club and the public institution.

In imposing the sentence, the court also took into account the fact that the former head of the basketball club is being tried for the first time, characterized by exceptionally positive behavior.

During previous hearings, A. Klimavičius’s defense attorney confirmed that the club had problems with fees, paperwork and accounting, but asked the court to acquit the former club director of embezzlement and waste.

According to the data in the case, the salaries of the Šiauliai basketball players and other employees were paid in cash, without formalizing it in the accounting records.

The unrecorded money was also used to pay for various goods and services paid for the rent of the basketball players’ homes and cars.

The court previously announced that in his closing speeches, A. Klimavičius denied having embezzled the club’s money. He claimed to have borrowed the money without interest to preserve the honor of the club and continue to exist.

The former club director also said that during his nearly 23 years in office, no basketball player has complained to the club about unpaid wages or poor conditions.

A. Klimavičius partially admitted his guilt for falsifying the accounts in court.

The Šiauliai Regional Court opened the case in the fall of 2019 and interviewed some 40 witnesses, some of whom were basketball players.

The Financial Crimes Investigation Service, which conducted a pre-trial investigation in this case, claimed that in 2014-2016, A. Klimavičius was able to seize more than 320,000 items from a basketball club and a public institution. euros.

According to the police, the club director was able to sign cash flow orders for the payment of several hundred thousand euros to two Estonian companies for the acquisition of the right to use the image by basketball players, but in reality this money was not paid.

The case of the director of Estonian companies, who could have helped the club director Šiauliai, is separated.

This court ruling can be appealed to the Lithuanian Court of Appeal.
