On Thursday, Attorney General Evaldas Pašilis addressed the Seimas, requesting the waiver of the immunity of these Seimas members. In addition, the commissions formed by the Seimas will decide on consent to prosecute, arrest or otherwise restrict the freedom of a member of the Seimas.
The investigation will be completed at the end of December.
According to the curator Irena Haasė, the commission on the waiver of V. Gapšis’s immunity will be made up of 11 members of the Seimas: Dalia Asanavičiūtė, Irena Haasė, Ieva Kačinskaitė-Urbonienė, Raimundas Lopatas, Bronislovas Matelis, Tomas Vytautas Raskevišinys, Linas Alytautas Raskevišnys. and Remigijus Žemaitaitis. The Commission will be chaired by I. Haasse. The study will be completed on December 23.
The liberal Eugenijus Gentvilas, for his part, wondered, “if it really is necessary until December 23. to lose ‘.
“Let us understand that on the 23rd, the last day of this Seimas session, all kinds of surprises can happen. I mean both the situation in Covid-19 and the request for breaks, etc. Then the problem could continue until March. I would ask the commission to reconsider its position, perhaps shorten it to about five days, ”suggested E. Gentvilas.
91 members of the Seimas voted in favor of the formation of the commission, there were no objections and abstentions.
At that time, the commission on waiving the immunity of P. Gražulis, according to the conservative Arminas Lydeka, who will be the chairman of the commission, will also complete the investigation by December 23. However, it suggests that the investigation be completed earlier if possible.
“Before the end of the session, the last date will be the date that the commission will make a decision in any case. We are already scheduled to meet in the commission next week. <...> I believe that next week we will be able to work and maybe even find a solution, ”said A. Lydeka.
98 The members of the Seimas voted in favor of the formation of the commission, there were no objections and abstentions.
Pleasant: the Attorney General lied
Fr. Gražulis himself claimed to the Seimas that Attorney General Evaldas Pašilis allegedly lied, mentioning what the Seimas member was suspected of.
“And for the car rental I did not pay. I have all the documents, all the orders. And because he had a profit of 1800 euros. I have all the documents. My contract stipulated that I had the right to refuel. For 350 euros a month, I paid rudely, and the prosecution calculates it completely differently, “said P. Gražulis.
He said he believed a political decision had already been made and that “no one needed justice.”
And nobody will want to delve into the bottom of the matter. It will say, let the court decide. Yes, I will still have the opportunity to tell not to you, deputies of the Seimas, but to the people what I think and why immunity is being lifted. I hope that the commission will partially analyze the problems with which I am accused. Today I was even more convinced that it was a political decision, since I criticized the captured media, the conservatives, Grybauskaitė ”, assured a member of the Seimas.
Try a second time
The Prosecutor’s Office has already requested the Seimas from the previous mandate to suspend P. Gražulis’ legal immunity in order to complete the pre-trial investigation into the allegedly illegal actions of the politician.
Last June, the Seimas rejected E. Pašilis’s request to waive the immunity of P. Gražulis. This time, the Seimas member denied the accusations made against him and claimed that the case was just a political deal.
Police suspect that P. Gražulis helped manage the problems of the frozen food company Judex when Russian officials found the Listeria bacteria in the company’s products in 2015.
Prosecutors said that while helping the company, a member of the Seimas had repeatedly called Lithuanian and Russian officials, asked for bribes, asked to violate existing procedures, and received property benefits from Judex.
P. Gražulis refused to testify as a special witness in the pre-trial investigation that began in 2016.
According to the prosecutor’s office, the pre-trial investigation into the abuse was completed last fall after using all available investigative possibilities. However, according to the prosecution, the fact that the parliamentarian was sworn in again after this year’s Seimas elections makes it possible to reapply for the waiver of the immunity of P. Gražulis.
The court wants to continue the case
The lifting of the legal immunity of V. Gapšis, a member of the Seimas and worker, is requested so that the Vilnius Regional Court can continue investigating the case of political corruption MG Baltic. He prosecutes a member of the Seimas for influence peddling and bribery.
There is an episode in this case where it is suspected that the former vice president of the MG Baltic company, Raimondas Kurlianskis, gave a total of 27.1 thousand in 2015-2016. bribes worth 1 million euros to the then member of the Seimas V. Gapšis.
The forces of order indicate that part of this amount was discounted when transmitting the announcements of the Labor Party in the television of the group, the other part of the funds was disguised as support to a public institution. To do this, V. Gapšys tried to influence members of the Labor Party to act in the interests of concern.
How is legal immunity waived?
If the Seimas approves the convocation of said commission, it must invite a member of the Seimas whose immunity is being resolved and a representative of the Prosecutor’s Office to hear it.
When the commission of inquiry prepares and publishes its conclusion, the question of the deprivation of immunity of a member of the Seimas will be placed on the agenda of the next session of the Seimas.
When considering the question of the deprivation of the immunity of a member of the Seimas, it will be limited only to the interpretation, assessment or clarification of the facts indicated in the brief of the Attorney General. The rapporteur of the commission of inquiry, the member of the Seimas whose personal immunity is being decided, or another member of the Seimas authorized by him and no more than 2 members of the Seimas who speak “in favor” and “against” will participate in the discussions. on the waiver of immunity.
If the conclusion of the commission of inquiry proposes to satisfy the submission of the Attorney General, the protocol resolution of the Seimas to agree to prosecute, arrest or otherwise restrict the liberty of a member of the Seimas may be adopted when more than half of all members of the Seimas vote for him.
If the conclusion of the commission of inquiry proposes not to satisfy the submission of the Attorney General, the protocol resolution of the Seimas not to consent to prosecute, arrest or otherwise restrict the freedom of a member of the Seimas may be adopted when more than half of the members of the Seimas vote for him. If the Seimas does not approve the proposal presented at the conclusion of the investigation commission so as not to satisfy the Attorney General’s presentation, a vote will be taken immediately to decide whether to agree to prosecute, arrest or otherwise restrict his freedom.
