It is proposed that the evidence of administrative offenses related to transport and road management in systems for recording fixed or mobile offenses in the absence of an official can be collected only in the presence of the information sign “Automatic traffic control” provided for in the Regulations. of traffic.

“Tripod” speedometers are an excellent preventive automatic violation detection tool designed to ensure traffic safety in the areas of cities most prone to accidents. However, this measure must fulfill a preventive function against administrative offenses, but not fines or intimidation ”, says D. Gaižauskas.

Currently, the Code provides for the determination of evidence of administrative offenses related to transport and road management, such as taking evidence of photographs or videos of a vehicle that records offenses or offenses registered by fixed or mobile offense registration systems. without the presence of an official.

However, as D. Gaižauskas points out, not all automatic damage detection devices have a mandatory information road sign.
In accordance with paragraph 636 of the Road Traffic Regulations, the information traffic sign “Automatic Traffic Control” is mandatory only for road sections where automatic (fixed) devices are installed to detect the set speed mode or other infractions.

“This means that this brand is optional for ‘tripods’ and other mobile automatic speedometers. In line with the objectives set, the proposed project aims to change the current legal framework,” says the explanatory memorandum.
