The 48-year-old judge of the Seventh District Court of Appeals in Chicago is considered a darling of social conservatives. They and other advocates on the right support Barrett’s decisions against abortion and the Affordable Care Act.
If A. Barrett were finally nominated and approved, she would become the youngest Supreme Court judge of all time. The new judge could contribute to the transformation of law and society for generations to come.
When Justice Anthony Kennedy stepped down in 2018, Trump was more supportive of Justice Bretta Kavanaugh. President Barrett later told supporters that he was “protected” to fill Ginsburg’s post if he retired or died, NPR sources said.
According to sources, this week’s conversation between Trump and Barrett went well, backed by Senate Majority Leader Mitch McConnell, who views her as a clearly conservative friendly candidate.
A. Barrett served as a federal court judge for three years. He wrote about 100 opinion pieces, according to The Associated Press, and showed a “clear and consistent trend toward the conservative side.”
A. Barrett would become the sixth Catholic judge. At this point, all except Sonia Sotomayor were nominated for Republican President. Neil Gorsuch grew up Catholic, but now considers himself an Episcopalian. The other two judges, Stephen Breyer and Elena Kagan, are Jewish.
Barrett criticized the 1973 Supreme Court ruling defending a woman’s freedom to have an abortion without government regulation. In 2016, she hinted that the court would likely overturn the decision leaving the right to abortion, but allowing states to take steps that make abortion more difficult, writes NPR.
While serving as a judge in the 7th District Court, Barrett wrote that the Second Amendment does not necessarily prohibit criminal convicts from owning weapons. He declared unconstitutional the Wisconsin law that prohibits those convicted of criminal offenses from carrying a weapon, even if it is not a violent crime.
Barrett voted in favor of a Trump administration rule that makes it difficult to give immigrants a green card if they receive money, food or housing assistance from the state.
Despite RBGinsburg’s request and objections from Democrats, Trump is rushing to implement pre-election plans to fill a seat on the court where RBGinsburg has turned 27 and his successor is promised to be announced Saturday.
