The unexpected visit of the police to the wife of Mindaugas Z. from Vilnius was like thunder from the clear sky, at that moment the man immediately understood why they were interested in his personal life: he visited several websites that publish erotic images many times. However, if a person does not distribute the records, there is no punishment in Lithuania: after the search carried out by the officers, the dark secrets of Mindaugas Z.’s life became clear.
Those who were not even known by a spouse who had lived with him for several years and was raising young children.
Anxious for Mindaugas Z., who works in one of the capital’s printing companies, he knew full well that he had stored many records of pornographic content on his computer and mobile phone, in which young children were filmed sexually exploited.
Specialists from the Office of the Inspector of Ethics of Journalists and the Forensic Medicine Laboratory of the State Forensic Medicine Service confirmed that the records kept by the Vilnius resident are pornographic and represent girls who are not even 14 years old.
The management of Mindaugas Z.’s home was instructed to carry out a search of police officers in the capital by the leadership of the Severe and Organized Crime Investigation Division of the Lithuanian Criminal Police Office. pornography with exploited children.
Forensic laboratory officials who inspected the computer equipment and mobile phone seized during the search confirmed that more than 1.3 thousand files were downloaded and deleted from the computer’s hard drive. records with young children, about a thousand more records were stored in a computer container that had already been deleted but not yet completely destroyed. It is true that man cannot be prosecuted for this.
But Mindaugas Z. had to be responsible for 48 recordings that were stored on his computer and one recording on a mobile phone; all these recordings were filmed by children under 14 years of age.
The Vilnius resident, who was stuck with indisputable evidence, admitted his guilt, but adored that the police officers “did not understand everything very much.”
“Yes, I did visit pornography sites, from which it is very easy to access other websites of a similar nature,” Mindaugas Z explained. And here he provided a version of how child pornography could have appeared on his computer without his knowledge. – I don’t know, but maybe pornographic websites support each other, so with the help of “banners” I also got to the pages where child pornography was visible. And the police have not blocked these pages. “
However, this still did not stop him: “While browsing erotic sites, I also saw images of child pornography. I only saw the images, but I didn’t download or save them, I just sent myself adult porn. “
The man did not hide the fact that sometimes when trying to access the advertised website, he would receive warnings or information that the website had been blocked by the police.
“I came to those pages completely by accident, but I never downloaded any videos from them,” Mindaugas Z admitted that advertised porn sites are generally accessed from his “Samsung” mobile phone. He was captured during the search.
“I’m not really interested in child pornography because I have a family, I raise children and I feel responsible for their safety,” the man said.
Judge Darius Lukaitis, a judge of the Vilnius City District Court, who examined the material collected by the prosecutor of the Vilnius District Prosecutor’s Office, Gedvydas Vaivada, in a criminal case, stated that there was no doubt that Mindaugas Z. “contained pornographic content that depicted a child.”
When sentencing a man who was prosecuted, the court took into account the nature, danger and integrity of the crime, as well as the guilt of the perpetrator: Mindaugas Z. committed an intentional (direct intentional) crime consummated to morals, which belongs to the category of serious crimes.
“The responsibility of Mindaugas Z. is mitigated by the fact that he admitted to having committed a criminal act and sincerely regrets, no aggravating circumstances have been identified,” said the court that the man works, previously illegal, but was administratively sanctioned seven times . the fines have been paid.
“The court decides that the objectives of punishment established in the criminal law will be achieved by imposing the least type of punishment established in Mindaugas Z. for the crime committed: a fine,” emphasized Judge D. Lukaitis, who adopted the criminal order, that the defendant pleaded guilty to the crime. court order, so the sentence imposed by the court must be reduced by one third.
The judge ordered Mindaugas Z. to pay a fine of 68 MGL (3,400 Eur) to the state budget. The convict will have to pay it to the state budget within 18 months.
In addition, the court decided to confiscate Mindaugas Z.’s mobile phone and computer – they were recognized as tools for the commission of a crime and therefore will be handed over to the State.
“It should be noted that without the confiscation of a computer and a mobile phone, a situation would occur in which a person who has committed a crime could reuse the property, a computer and a mobile phone, to commit crimes,” emphasized the Judge D. Lukaitis. “Such a situation would not only constitute a provision of impunity for the individual, but would also facilitate the recidivism of that person, without thus ensuring the nature of the preventive measures, including the confiscation of property.”
Delphi wrote that Lithuanian courts annually review dozens of criminal cases of illegal possession of pornographic records depicting children. Most of the time these are children filmed abroad, but officials have also recorded cases in which minors or minors are persuaded or even voluntarily send their photos to perverts, who often also pretend to be girls.
“While keeping records of child pornography is an easier crime than distribution, the very fact that a person is interested in such things is already a serious sign: it is necessary to take an interest in what we do,” authorities said.
