The case found that EN had cruelly treated the animal, resulting in the death of the animal, that is, he was on New Year’s Eve around 11 p.m. in the yard next to the house, stabbed a German shepherd dog from the EU with a knife in the sacrum area. With this puncture, the animal was mutilated and euthanized approximately one month later due to complications from the wounds suffered.
During the trial, EN did not deny that he stabbed the dog with a knife, but did not plead guilty to the crime with which he was accused, claiming to have defended his hybrid dog from a neighbor’s dog who attacked the latter.
After evaluating the evidence in the case, the court concluded that the victim’s dog had not taken any action that could be construed as a threat to the other dog and its owner. Therefore, it was not necessary to injure the victim’s dog. A stab with a knife for a pet (a dog) in the sacrum area without any obvious danger to the man or those around him, was judged by the court as cruel treatment towards the animal.
In passing judgment, the court took into account the fact that the man was convicted for the first time, committed an intentional misdemeanor, was working, and his income was low. Although EN did not admit his guilt, the court assessed that he, despite the conflicting relationship with the victim, regretted having injured the animal, realized that the owner of the animal could survive the loss of his animal.
The court found EN guilty and sentenced him to six months of public works, forcing him to work 20 hours a month without pay in the public interest during that period.
The court partially upheld the victim’s claim and awarded EN 1010.70 € for pecuniary damage, € 500 for non-pecuniary damage and € 700 for representation expenses.
The judgment can be appealed to the Klaipėda Regional Court within 20 days from the date of its publication through the Klaipėda City Hall of the Klaipėda District Court.
