Police support the proposal to penalize vehicle owners rather than drivers for speeding in certain cases, and suggests expanding the range of crimes even further.
“The police believe that vehicle owners should be responsible for all violations of traffic regulations recorded by technical means, and not just speeding. For example, stopping in an unauthorized place, talking on the phone while driving, driving with a red light, ”said Ramūnas Matonis, a representative from the Police Department.
“In cases where an officer arrests the offender and there is a clear driver, then the driver would be punished immediately, it is illogical to punish the owner,” he added.
Paulius Saudargas, a member of the Seimas Homeland Union-Lithuania Christian Christian Democrats (TS-LKD) faction, last week registered an amendment to the Code of Administrative Offenses, which changes liability for speeding.
It is proposed to penalize the vehicle owner in certain cases, when the infraction is detected by a special team. Currently, liability for speeding is reserved for the offending driver.
“In practice, when a stationary traffic violation recording device detects an overspeed device, it is not always possible to accurately identify the person driving the vehicle. Citizens, in an effort to avoid liability, especially the strong fines or disqualifications for speeding, can affirm that they were not driving, “said Saudargas.
“When cases end in court, the attribution of liability is complicated and the working hours of state institutions are delayed. The definition of liability for the vehicle owner makes the process clearer and simpler and implements the principle of inevitability of liability. In this case, the deprivation of the right to drive vehicles would not apply, “argued the MP.
According to Prime Minister Saulius Skvernelis, this is an issue to consider.
“In terms of efficiency and recovery, it is an effective tool, but for several years it has been offered in various ways in Lithuania,” he said at a press conference last week.
If Seimas decides to approve this draft amendment to the law, the new procedure will come into effect early next year.
