“Both my defendant and the passenger in the same car with him said that the driver of another car was to blame for this terrible accident,” Vidmantas Martyšius, a well-known lawyer in the capital, said on Monday.
And if this is really the case, Vaida Sinkevičienė, judge of the Vilnius Chamber of the Vilnius Regional District Court, is already clarifying in several court hearings.
Police and prosecutors who carried out a pre-trial investigation into a terrible accident in the Vilnius district two years ago brought charges against the traffic accident involving Dariuš Kutko, a 22-year-old district resident who had not previously dealt with police.
In 2019, a tragic accident took place in the Vilnius district, Naujieji Piktakoniai village, on the Rudamina-Turgeliai highway. on August 22, when around 2.36 pm the Jeep Grand Cherokee and the Audi 100 collided. The Audi was forced to hit and then went into the ditch, and a 19-year-old driver and an 18-year-old passenger who died were immediately killed and were pulled from the crushed vehicle by firefighters.
Although the Jeep Grand Cherokee suffered irreparable damage after the collision, its driver D. Kutka and his friend who were traveling together suffered minor injuries. That night they both left Belarus, where they had gone to refuel with cheaper fuel.
Both the fatalities and the off-road driver and passenger were sober during the accident.
Immediately after the accident, the agents who began the investigation were taken to the covers of the sewer wells that fell from the “mink” of the dead; there were seven of them, each weighing 63 kg. Furthermore, it turned out that they were possibly stolen from the Šalčininkai utility farm, and the trunk of the car in which they were stored was not separate from the cabin.
V. Martyšius, defense attorney for the defendant D. Kutka, said that although the drivers of both vehicles did not exceed the speed limit and drove at about 80 km / h during the collision. speed, it is not difficult to imagine the force that the metal caps threw on the victims after the collision.
Mr. Kutka, who is accused of a tragic accident, has so far refused to testify in court, but both he and his friend who accompanied him told authorities after the accident that a car driven by them, but for a A deceased driver entered the opposite lane and collided with an off-road vehicle.
“During the pre-trial investigation, several questions were asked about these circumstances, but the experts have not yet provided answers on the specific location of the car collision,” believes V. Martyšius, a lawyer defending D. Kutka, who in absence of such an important answer, the defendant may be guilty of the death of two people.
According to the lawyer, although there were many scratches on the road after the car crash, the policemen who inspected the place marked only one and what confirms that it was the SUV that entered the other lane of traffic. The defendant disagrees with such conclusions, asks the criminal court to order another complex examination and answer any questions that arise.
Tatjana Skirtun, a father who lost his nineteen-year-old son during the accident and his lawyer, believes that the experts have already answered all the questions. Such position was also supported by the state prosecutor supporting Egidijus Motiejūnas: “The experts have already been interviewed, they have expressed their position, therefore now there is only a legal evaluation.”
The family of the guy who drove the Audi 100 and died in the traffic accident seeks compensation from the defendant and the insurance company not only for the expenses incurred for the son’s funeral, but also for the moral damage estimated at 100,000. euros.
“It is still very difficult because I lost my 19-year-old son, but of course they will not bring him back,” the victim told the court. The man made no secret of the fact that both he and the mother who survived her son are still taking medication and in no way can accept the loss.
“I only found out about the loss of my son in the morning, around 6 in the morning, when a friend called me and informed me of the message,” he said, speaking with difficulty. And he added that he still feels sorry because the defendant not only did not attend the funeral, but also did not apologize for the tragic accident.
“The son was calm, he worked with me in construction, he also helped me repair the roofs, did all the field work at home, and both the school principal and the entire class with which he graduated came to his funeral.” said the father, who was suffering.
If Kutko is proven guilty in court, he will face up to eight years in prison. Until the court finds him guilty, the defendant is presumed innocent.
