“People have lived in conditions that guarantee neither dignity nor security for a long time. Most of the camps were run while their perimeter was guarded, and what happened inside was left to self-regulation. But before talking about the conditions, you have to ask yourself why they are being detained without a judicial decision ”, asks the lawyer at the beginning of the discussion.
A member of the TS-LKD faction, responding to a lawyer’s question, recalls the amendments to the law on the legal status of foreigners approved by the Seimas in mid-July: they restricted the free movement of people crossing the border illegally on the territory of Lithuania. According to the member of the Seimas, the objective of the amendments to the law is not to open another migratory route.
“If we had not imposed restrictions, the news would reach the communities of those countries – Iraq, Iraqi Kurdistan and other places – that it is possible to travel to Lithuania, because no one will stop them here (…) Basically, we would have encouraged another plan of illegal immigration. I believe that the State has acted in principle and with reason ”, explains L. Kasčiūnas.
The Seimas member also emphasizes that the illegal migration that has hit the state is an organized part of the Lukashenko regime’s plan. However, in the lawyer’s opinion, this does not justify the decision to detain migrant families wishing to come to Lithuania.
“It doesn’t matter what we call the situation: if it’s a hybrid war or all the other horrors, even the Martian attack. There is a general principle in international law that families with children cannot be detained simply because they have arrived and applied for asylum. For the moment, we have done exactly the opposite: we have had very serious negative consequences for people and we have been detained for six months without any judicial decision. There is no such possibility in a democratic state, ”says the lawyer.
According to the member of Seimas, the return policy for illegal immigrants and poor accommodation conditions was a well thought-out solution to protect the borders of Lithuania and the European Union. He asked the lawyer to provide an alternative to the current strict but, in his opinion, effective measures to control the migration crisis.
