On Friday, the Vytautas Kernagis Foundation announced that it had submitted an application to the copyright protection associations LATGA and AGATA regarding the V. Kernagis songs played at the Family Defense March upheaval events. At the time, LATGA and AGATA warned the organizers of the march that some musical works were being used illegally without the consent of the authors.
The associations circulated a message that the organizers of the March for the Defense of the Family have not granted a license to use music at the event.
“In response to the sensitive political context of the Great Family Defense of March 2021, we inform AGATA members and the public that we have not granted a license to use music at this event,” AGATA reports.
According to the association, the organizers of the “Great March for the Defense of the Family” use the recordings of Vytautas Kernagis, Ieva Narkutė and other artists at their events.
“We publicly ask the organizer to stop the unlicensed public use of music that is not coordinated with the creators or their representatives. If we do not, we will protect the violated rights of the developers by legal means,” writes AGATA.
According to the LATGA association, in accordance with current legal acts, the event organizers who wish to use the works must request it from the association no later than two weeks before the event, and the organizers of the “Great Family Defense March 2021” they did not. . “
LATGA indicates on Friday that it reminded the organizers of the obligation to enter into a contract if the works of the authors represented by the association will be reproduced during the event.
We have also attached to the organizers a list of authors and other rights holders who do not allow the use of their works at the event. The LATGA association has no legal basis on its own initiative for not granting a public performance license. Authors who do not want their works to be represented in public during said event have the right to inform LATGA, which in turn will inform the organizers, ”the report indicates.
The associations reacted after being contacted by the Vytautas Kernagis Foundation regarding the illegal use of the works.
“All the music released so far in the great events of the Great Family Defense in March 2021 was played illegally, because the organizers had not concluded agreements with the LATGA and AGATA associations,” says Eglė Kernagytė-Dambrauskė, daughter of V Kernagis one of the founders of the foundation.
Therefore, we will await the reaction and action of the associations on this issue. Furthermore, the lexicon, values and aggressive and degrading attitude of the organizers of the march towards other people are in no way in line with the idea of freedom, respect and tolerance that the work of V. Kernagis carries. Therefore, we categorically declare that we do not agree that the songs of Vytautas Kernagis and his personality are in any way related to this event and we completely distance ourselves from it ”, says the daughter of V. Kernagis.
„V. Kernagis has become a symbol of freedom singing in Lithuania, so it is very important that her songs are used in that context. How and in what way the Great Defense of the Family March 2021 spreads its ideas is unacceptable to our family, so the father’s songs cannot be played at that event. Everything is simple and clear, ”said the teacher’s son, MP Vytautas Kernagis.
The Vytautas Kernagis Foundation requests that no licenses be granted to use the teacher’s songs in the Family Defense March.
A Family Defense March will be held in Vilnius on Saturday, with participants seeking to protest against the Istanbul Convention and other initiatives that they say are directed against the traditional family.
Organizers say they oppose the initiatives of the ruling majority, which they consider contrary to the Constitution, the introduction of the concept of gender in educational institutions. According to them, the initiatives considered would be contrary to the constitutional principle of allowing parents to raise their children according to their beliefs.
The initiator and leader of the event is Raimondas Grinevičius, a former “manager”, among the organizers is the humorist Artūras Orlauskas, member of the Algimantas Rusteika National Association, responsible for the website infa.lt Arvydas Daunys.
