On Monday, a court hearing an unusual case behind closed doors decided to acquit the defendant after reconciling with the injured mother.
Three doctors were accused of telling the victim and her spouse, after learning of a foreign body left during a cesarean section in order to disguise it and act as a group of accomplices, that the victim needed to be operated (laparoscopy) for reasons unrelated to doctors.
Klaipėda District Court Spokesperson Jūratė Volčkova lrytas.lt He said that protecting the privacy of the victims could not indicate exactly what foreign body was left during the operation. “We cannot go into details. This is related to the victim’s right to privacy,” explained J. Volčkova.
Thus, the doctors who tried to hide the error falsified the documents: the minutes of the doctors’ council indicated the false reason for the new operation, which was also transferred to the documents that detail the laparoscopy performed on the patient. During this operation, a foreign body was found and removed from the woman’s abdomen. Then the operation protocol was falsified and the cause of the operation was not clarified.
According to the report, when ruling on the issue of the defendant’s acquittal, the court took into account that the defendant admitted his guilt, regretted his behavior, and jointly and severally compensated the victim for the damage caused by the criminal acts. They also apologized to the victims and reconciled with her, deeply regretting and regretting their behavior, realizing the negative consequences of their criminal actions.
The victim accepted the apology, did not object, and agreed that the defendants would be acquitted if they reconciled. In addition, the accused have not been previously convicted, have not been administratively sanctioned, have higher education, many years of work experience in the field of medicine, work, there is no material that negatively characterizes the accused in the case. All the circumstances discussed allowed the court to conclude that the defendant would not commit further crimes in the future.
The court imposed a criminal sanction on the defendant: the obligation to pay a contribution to the fund of the crime victims, establishing the amount of 10 MSL, i. and 500 Eur. The judgment can be appealed to the Klaipėda Regional Court through the Klaipėda City Council of the Klaipėda District Court within twenty days from the date of the delivery of the judgment.
