Two people were sitting on the bench of the Kaunas Regional Court. The murder charges fell on the shoulders of Darius Navickis. Arvidas N., convicted of complicity with the body, found D. Navickis guilty of murder and sentenced him to 14.5 years in prison.
To this number was added another part of the previously unfulfilled sentence, which meant that D. Navickis would be isolated from society for up to 17 years. Arvid N., who helped cover up the crime, was sentenced to probation at the time.
However, that is not the end of the story. Mr. Navickis, who did not plead guilty, appealed to the court. He requested full acquittal because, according to the murderer, his guilt had not been proven during the Kaunas trial.
Killed in one fell swoop
According to the case, the crime was committed in 2015. on the afternoon of December 16. In a room on the second floor of a residential house owned by Arvid N., intoxicated with alcohol, D. Navickis had a conflict with SP
Due to a trivial reason (when the victim asked to buy alcohol – aut. Past). Angry at the absorber, D. Navickis once intentionally hit him with a ceramic teacup on the head area. Doing so causes the victim a forehead wound.
After this blow, the victim lost consciousness. Then D. Navickis along with Arvid N., in a defenseless condition and unable to resist the SP with both hands, lifted him off the ground and stretched him out.
They dragged their bodies into the rain and into the fecal drainage pit in the house’s yard. According to the case file, Arvidas N. opened the manhole cover and D. Navickis threw the SP’s head into the well and they both covered the cover together.
In this way, the unconscious SP created conditions incompatible with life, resulting in the death of the man in the well. In court, the actions of D. Navickis were treated as the murder of a defenseless person.
The fact is that although the crime was committed in 2015. in December, but the body of the murdered man was only discovered two years later. Arvidas, N.
Deny your guilt
On appeal, D. Navickis’s lawyer requested the man’s acquittal, alleging that his guilt had not been proven in the commission of the criminal offenses against him.
According to the lawyer, the guilt of D. Navickis was artificially constructed, ignoring the extremely important circumstances of the case, which are confirmed by objective data and witness testimony. The goal was to ease the situation of another inmate, Arvid N., who had previously worked in the police system.
The lawyer emphasized that D. Navickis’ position had not changed since the pre-trial investigation: “He categorically denied that he was involved in the murder of SP. He learned of the victim’s body hidden in a sewer pit on the estate of another convicted Arvido N. only a few months later from Arvido N. himself, who revealed this fact to him while he was drinking.
There is no objective evidence of Mr. Navicki’s guilt in the case, no possible serious reason has been identified as to why he could have been involved in the murder of SP or at least used violence against him. “
D. Navickis’s attorney was also surprised that the court relied on the words of her husband’s partner. She said Navickis uttered a sentence about some kind of murder in her sleep. According to the representative of the murderer, the fact that D. Navickis has been convicted more than once cannot be considered as proof of his guilt, confirming his alleged propensity for uncontrolled aggression.
“Although the court indicates his alleged propensity for uncontrollable and brutal aggression, especially under the influence of alcohol, this is not confirmed with objective data or with the testimony of witnesses, except for the testimony of the convicted Arvid N. The guilt of D. Navickis relies basically only on the testimony of another convict, ”D. Navickis’s attorney told the court.
Despite all the best efforts of D. Navickis and his lawyer, the Lithuanian Court of Appeal ruled that the person had been proven guilty and the sentence was not changed.
