Complaint to the prosecution

Yesterday, Vakaro žinios announced that Jonas Valaitis, who was the editor of the LGBTQ + news portal Jarmo.net, complained to the prosecution Vita Tomkus, the editor-in-chief of the Republic, about his essay.

The young activist was caught by the phrase in the column of V. Tomkus that appears on the bankas.lt portal – “I understand that the content there corresponds to the taste of the partners of the LGBT Seimas coalition, but for me Tomas Vytautas Raskevičius , who was a member of the Seimas and does not want to leave the signatures of the president of the Human Rights Committee even after a third of the million signatures collected against him, did not want to leave.

The information circulated indicates that the author received a letter from the Vilnius Regional Prosecutor’s Office stating that a pre-trial investigation had been launched under the article of the Penal Code, which stipulated responsibility for incitement against any nation, race, ethnicity, religion or other group. This is punishable by a fine or restriction of liberty, or arrest or imprisonment for up to two years.

The initiator’s responses are formal

Internet commentators wrote to V. Tomkų about the complaint against prosecutors that J.Valaitis is “a gay man who caused scandals in Klaipėda. We don’t know if this is true, but another comment from commenters that J.Valaitis has sued Lithuania in Strasbourg is absolutely true. The investigation was denied and an unappealable court ruling was issued in early 2019. In total, J.Valaitis reported. more than 20 comments, but only one person was identified during the year, although the Office of the Inspector of Journalistic Ethics concluded that the comment was inciting hatred, the police decided to suspend the investigation, then J.Valaitis appealed to the ECHR and received a message At the end of last year the prosecution resumed the investigation because it had received a letter from the ECHR.

“Vakaro žinios” also contacted J.Valaiitis, who filed a complaint against V. Tomkus’ trial. J.Valaičius did not have the courage to answer the questions, so he provided written answers.

J.Valaiitis was asked to specify what specifically got stuck in V. Tomkus’ basement. It was answered in the abstract that “Jarmo.net strongly opposes hate speech based on a person’s gender, race, gender, age, nationality or other identity.”

After inquiring about the expected outcome of the complaint, J.Valaitis emphasized that “when conducting a pre-trial investigation, the prosecution must follow the laws of the country, the CPC and carry out the actions provided for therein. That is to be expected.

The editor of the portal was reluctant to speak about his case against Lithuania: “the case is being examined by the ECHR, the final decision has not been made.”

The question about the attitude towards dissidents and freedom of expression also received a formal answer: “according to the Constitution and the laws of the Republic of Lithuania, people enjoy freedom of expression and of the press, but this right is incompatible with criminal actions “. It is true that the actions of V. Tomkus and applied to the forces of order, were criminal, J.Valaitis did not specify.
