It is already known which Vilnius residents are not allowed to smoke on the balconies – a list of addresses has been published

The law states that the owner of an apartment or another natural person who uses the apartment and smokes in it must ensure that tobacco smoke does not enter the premises of another owner’s apartment and the premises of the same apartment.

Upon receiving a personal objection, the municipality prohibits smoking in an apartment building by order.

The law has received contradictory opinions on the violated rights that do not create conditions for smoking, because there are no apartments designed with rooms for smokers. Smokers, on the other hand, smoke where they fall, sometimes with no thought for safety.

When smoking is prohibited in an apartment building, the owners of the apartments and other facilities in the apartment building are informed and informational signs are installed.

The orders of the director of the municipal administration prohibiting smoking in apartment buildings are made public. According to March data, there are one hundred and a half apartment buildings of this type in Vilnius. You can see if your apartment is on this list here.

Those who do not comply with the smoking ban can be fined between 20 and 90 euros.

By the way, people can report violations of the smoking ban to the police or the municipality if they have declared a place of residence in the apartment building. The complaint must be accompanied by data confirming the fact and circumstances of smoking on the balcony, terrace, loggia of the apartment building.

Article 19 (8) of the Law on the Control of Tobacco, Tobacco Products and Related Products stipulates that, at the request of an official of the police or municipal administration, the owner of an apartment or premises or the holder of other rights real must data (name and address of residence).

Without specifying the data of a person who smoked on the balcony, terrace, loggia of the apartment or room, the person is liable under article 492 of the Code of Administrative Offenses of the Republic of Lithuania and can be fined from 30 to 120 euros.
