LVŽS President Ramūnas Karbauskis notes that the Minister, in attempting to increase tuition fees, acted in a particularly rude manner, violating the deadline set by law, which states that tuition fees for students admitted in the respective year must be approved before January 15 of that same year. year.
“The ministry did it even two weeks later, on January 29, when the deadline was already expiring, and the students had already planned where they would be and, together with their parents, had evaluated their financial possibilities. Such conduct by the Minister violates the constitutional principles of legitimate expectations, the rule of law and responsible management, and an order whose adoption procedure violates the law cannot be considered lawful. The Supreme Administrative Court of Lithuania has repeatedly recognized this in its practice.
Therefore, we ask the Minister in good faith to cancel the increase in tuition fees, to seek opportunities to finance education in other ways. If this week the minister does not declare her illegal order invalid, I will ask the members of the Seimas to appear before the Supreme Administrative Court of Lithuania and work to have that order annulled, ”says R. Karbauskis.
According to the president of LVŽS, R. Karbauskis, the aspiration to revoke the order of the Minister of Education, Science and Sports, ensuring the widest possible access to studies for Lithuanian children, will be a priority for the shadow government of LVŽS , which will take it in mid-February.
“It is clear that the minister’s order is not only illegal, but also wrong. It is irresponsible to prevent higher education for those children whose parents are not wealthy. This order continues the saddest traditions of the conservatives: it further divides Lithuania into an “elite” who will have the right to education and a “fund” for which education will not be available, because the rising price of 1000 euros or more deprives anyone. poorest children of any opportunity to study.
During the last quarter, LVŽS expanded the number of state-funded places in undergraduate studies, thus ensuring that higher education is accessible to children who want to study and have talents. Now we see how the opposite direction has started ”, says the president of LVŽS.
The Science and Studies Law establishes that “the standard tuition fees for students admitted in the respective year will be approved by the Minister of Education, Science and Sports before January 15 of each year.”
According to the Administrative Procedures Act, the members of the Seimas, the ombudsmen of the Seimas, the officials of the State Audit Office, the county governors, the general powers and the specialized law have the right to go to an administrative court with a statement to an administrative court to investigate whether a regulatory administrative act (or part of it) adopted by a public administration entity conforms to the Law. Both the courts and the prosecutors.
