On Thursday, the president of the Seimas V. Pranckietis confirmed that A. Kabišaitis, the Head of the Legal Department of the Seimas Chancellery, is being nominated as a judge of the CC.

According to the President of the Seimas, according to the law, the candidacy of A. Kabišaitis can be presented in the Seimas after three months, and this time the nomination presentation time will not be coordinated with the Presidency and the Supreme Court of Lithuania (LAT ).

In April, the Seimas rejected the three nominated candidates for the CC judges. The President of Seimas V. Pranckietis nominated former CC Chancellor Ingrid Danėlien presidente, President Gitanas Nausėda – lawyer Giedrė Lastauskien entonces, the then acting President of the SCL Sigita Rudėnaitė – the judge of this court Algis Norkūnas.

President Rudėnaitė had been nominated as the permanent head of the SCL. His candidacy was also rejected by the Seimas and at the same time removed from the post of President of the Civil Division of the SCL. This situation is now being clarified by the CC, which accepted Seimas’s appeal to assess whether the Presidential Decree and the Seimas Resolution had been properly formulated after the removal of a judge from office without a legal basis.

The President has confirmed that he intends to re-present the two candidates rejected by the Seimas to the courts, since he has not heard the reproaches expressed during the hearing in the Seimas.

The Constitution establishes that the Constitutional Court is renewed every three years by one third. The court is made up of nine judges appointed for nine years and for one term only.
