As reported by the SFVS, dairy terms in principle cannot be legally used to describe a purely plant product. The Authority notes that the name “milk” and names that refer only to dairy products can only be legally used to describe a purely vegetable product in exceptional cases, that is, if the product is included in a specific list of exemptions approved by a EC decision.
The SFVS also commented that, in order to reduce the administrative burden on producers and distributors, it has granted a transition period that has allowed companies to sell waste from existing products and produce new labels in accordance with the legislation. Almost a year, until 2019. January 1 – the period was designed to allow the company to prepare for the new requirements and to avoid losses.
SFVS specialists emphasize that the decision taken does not refer to the prohibition of the use of the company name, but only to the use of the trademark “Butter Butter” and other labeling claims on the labeling of plant products. The use of the company name (MB “Butter Buttered”) is not restricted by the ECJ decision, so it can continue to be used to indicate manufacturer details on all products.
It was previously announced that after SFVS banned the use of the trademark “Butter with butter” for nut butter, the Minister of Economy and Innovation Aušrinė Armonaitė submitted a request to the Service, requesting to ensure the clarity of the regulatory environment.

According to her, smooth supervision should be based on the principles of prevention, advice, cooperation in good faith and prudential criteria, and responsible authorities should do everything possible to ensure that the requirements of economic operators are motivated, clear, logical, consistent and unequivocal.
“I hope that this becomes a new standard in Lithuania and that we spend less and less time on stories like this,” says the minister.
The SFVS states that in 2017, the European Court of Justice ruled that the term dairy products could be called plant foods. According to the service, that name misleads consumers. On Wednesday, this issue will also be raised at a meeting of the Seimas Rural Affairs Commission.
