A repeat offender who beat a girl in Kaunas and then drowned in the Nemunas was imprisoned for 12 years.

After evaluating the testimony of the defendants on the circumstances of the incident, witness testimony, data recorded in inspection reports, conclusions of specialists, other evidence examined at the court hearing, the court concluded that VANarbutas was established indisputably in the middle of October 2019, near the Nemunas river near Žalgiris. Arenas, being intoxicated with alcohol, which influenced the commission of the crime, during a personal conflict with the woman, deliberately struck at least 13 blows to the head and other parts of the victim’s body.

Continuing with the crime, he arrested the victim, dragged him to the Nemunas and shoved him deep. Then he dipped it in water and left. As a result, the victim died after drinking water.

During the investigation and in court, the accused confessed to having committed a crime, according to the Kaunas Regional Court report.

He indicated that he was angry when the victim pushed him by the hand, causing him to fall into the river. Then he hit her hard with a fist. The victim fell to the meadow from his blows, but he ignored him and continued to beat the lying woman, and when he thought the victim was dead, he dragged her into the water, pushed her to the bottom of the river, towards the stream, waiting for the current take it away.

The court determined that the defendant struck at least 13 blows to the victim’s head and then, after losing consciousness, threw him into the water, so he realized and anticipated that the woman could die. Although the accused stated that he did not seek the death of the victim, he did not take any measures to avoid such consequences.

The court recognized the aggravating circumstances of the accused of having committed the crime while intoxicated and as a repeat offender (convicted on 5 occasions), and by mitigating the responsibility for having confessed to having committed the crime and having sincerely regretted it.

The court disparaged the fact that the defendant hit and threw a young woman still alive into the water, causing her death, for committing a new very serious crime while she was convicted and with a valid criminal record, and recognized the defendant as a dangerous repeat offender.

In deciding the sentence of the accused, the court took into account the nature and degree of seriousness of the crime, the form and type of the crime, the objectives and motives of the crime, the personality of the accused and the above-average sentence of 12 years in a penitentiary.

The court awarded 450 euros in pecuniary damages and 25,000 euros in non-pecuniary damages to the murdered mother.

The judgment can be appealed to the Lithuanian Court of Appeal within 20 days through the Kaunas Regional Court.
