Tears of emotion and relief for Vaidas Jankauskas flow at the Kaunas Regional Court, where the verdict is announced that his wife Jurgita is not guilty of the death of their two-year-old daughter, on November 1, 2014, in a tragic accident in Varėna district.

“Here is a great victory after so long, and the second court has already decided that I am innocent,” says acquitted mother Jurgita Jankauskienė.
Although this acquittal was announced by the Varėna Chamber of the Alytus District Court on December 1 last year, the prosecutor Regina Juškevičienė appealed against it to prove her mother’s guilt.
The prosecutor disagreed with the lower court’s findings. It is believed that not enough evidence was gathered to support the guilt of the woman and, in the prosecutor’s opinion, the court incorrectly evaluated the data collected in the case, the guilt of the woman and considered her possibly guilty, “says the representative of the Gabrielė Petkuvienė prosecutor’s office.
However, the Kaunas Regional Court rejected the prosecutor’s complaint.
“After examining the case, the panel of judges found no such errors in the judgment of the lower court; it recognized that the judgment was legal, reasonable and fair,” said Judge Jūratė Jakubonienė.
The prosecutor’s office can still appeal the decision to the Supreme Court, or will use the last chance, which has yet to be revealed.
“The Alytus prosecutor who supported the state prosecution will familiarize himself with this verdict, the reasons and then decide whether to appeal this cassation to the Lithuanian Supreme Court on cassation,” says G. Petkuvienė.
The family had previously shared photos of the tragic accident with TV3 journalists. It took place on the Valkininkai-Daugai-Vilnius highway. The “Toyota” was driven by Jankauskienė, who showed a turn from a distance, stopped to turn into the parking lot on the left, missed all cars traveling in the opposite direction.
At that moment, a column of cars formed behind him, which, according to witnesses, was much faster than the luxury SUV “Audi Q7”. The family hopes that the real culprit, the businessman who was driving, will be punished.
“I hope a real culprit is found,” says J. Jankauskienė.
The pre-trial investigation should now resume, according to lawyers, with enough data in the case to prove the fault of the driver of the particular Audi Q7.
“This case was started on the basis that the Audi driver is at fault, preliminary data is that the Audi driver is at fault, not Jurgita Jankauskienė, this has only been confirmed by the courts, witness testimony, conclusions of independent experts, scientific conclusions, we have presented them ”, says Stasys Survila, lawyer of the father.
“All the evidence showed that the other driver was the culprit,” said Linas Kuprusevičius, his mother’s lawyer.
The decision to open a new pre-trial investigation could be made later this month.
